Davidson opened the public hearing calling for anyone wishing to speak on this ordinance. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments, questions, or motions. <br /> <br />Davidson clarified that this ordinance is the most restrictive ordinance that State law will allow. <br /> <br />Mayer moved that Council approve Ordinance No. 1193, Series 1995, on second and final reading. <br />Seconded by Lathrop. Roll call was taken. Motion passed by a 7 - 0 vote. <br /> <br />ORDINANCE NO. 1194, SERIES 1995 - VACATING A PORTION OF HARPER STREET, <br />AND LINCOLN AVENUE AND A 7.5 FOOT STRIP OF LAND WITHIN THE FISHER <br />SUBDIVISION AND DECLARING AN EMERGENCY - 1ST READING - SET PUBLIC <br />HEARING 7/18/95 <br /> <br />Griffiths read by title only Ordinance No. 1194, Series 1995, "An ordinance vacating a portion of <br />Harper Street, and Lincoln Avenue and a 7.5 foot strip of land within the Fisher Subdivision and <br />declaring an emergency." <br /> <br />Bill Simmons, City Administrator, stated that in 1985 the City conveyed certain property, but failed <br />to vacate those portions of Harper Street, Lincoln Avenue, and the 7.5' strip of land in the Fisher <br />Subdivision. There is a sale pending on this parcel and this ordinance vacates those portions of <br />property and declares an emergency. The closing is scheduled for the end of July 1995. <br /> <br />Davidson called for Council questions, comments or motions. <br /> <br />Mayer moved that Council approve Ordinance No. 1194, Series 1995, at first reading, set out for <br />publication, and set a public hearing for July 18, 1995. Seconded by Keany. All in favor. <br /> <br />RESOLUTION NO. 38, SERIES 1995 - SEVEN OAKS ACADEMY, FINAL SUBDIVISION <br />PLAT AND FINAL PUD DEVELOPMENT PLAN <br /> <br />Paul Wood, Planning Director, stated that the purpose of this resolution was to construct a 10,080 <br />s.f. child care center on proposed Lot 1, with will be 1,059 acres. No development was pending at <br />this time for proposed Lot 2, which will be 1,226 acres. The one story child care center, with the <br />center portion of the building containing a gymnasium with a high ceiling. They proposed a 6,250 <br />s.f. outdoor play area enclosed by a 10' high wood privacy fence. There will be 31 parking spaces. <br />One 16 s.f. wall sign is proposed on the fascia of the porte-cochere above the front entrance. Total <br />landscaping is at 32.3% of the site. <br /> <br />Davidson called for the applicant's presentation. <br /> <br /> <br />
