Anne-Marie Patrie, 748 Orchard Court, Louisville, Colorado, spoke in favor of this resolution. She
stated that this allows builders to put in homes with more architectural variety and interest.

Robert Hardy, 824 LaFarge Avenue, Louisville, Colorado, a member of the Board of Adjustment,
stated that this problem and others like it were self-created by the builders. He encouraged Council
to do whatever was necessary to correct the situation.

Lowell M. Campbell, 586 Cleveland Avenue, Louisville, Colorado, brought and reviewed, for
Council's consideration, the exhibits that had been presented to the Board of Adjustment. He asked
Council not to approve this resolution.

Ramon Griffin, 555 Orchard Drive, Louisville, Colorado, the original applicant of the amendment to
the final PUD, recommended that Council approve the resolution.

Davidson called for Council comments and questions.

Levihn stated that the recommendations of staff had met the needs of the subdivision and possibly
improved the subdivision by giving it some variety.

Howard asked how many lots there were that were greater than 115' in depth.

Wood stated there were about 20%, mostly perimeter lots.

Keany directed the City Administrator and staffto look into, if the Building/Planning Departments
felt that plans or surveys had been illegally altered, stop work should be issued immediately and legal
action should be taken.

Wood stated that they would, at the first indication of noncompliance, take appropriate action.
Mayer felt that there should be an additional requirement that the houses also be single story.

Lathrop did not feel Council had envisioned large homes on the west side of the subdivision buffeting
what will be and is commercial uses. He did feel the adjustments asked for were not unreasonable.

Davidson announced that Councilman Keany had just been called away on an emergency. To pass
this resolution, three affirmative votes would be needed or a majority of the Council present.

Davidson also asked Wood to turn over the documents in question to the Police Department or the
Prosecuting Attorney for their review. Davidson asked if there were any houses already constructed
that would require the 12' setback for their current construction.

Wood stated there was just the one, Mr. Griffin's house at 555 Orchard Drive, which is set back 17'.
