Local Licensing Authority <br />Minutes <br />February 23, 2015 <br />Page 4 of 5 <br />taken and it was decided there would be a quorum. Hughes seconded the <br />motion. All in favor. <br />Police Department Reports <br />A. Incident Report — Henry's — 10/26/14 <br />Police stop a pedestrian who reported drinking at Henry's. This item was <br />reviewed by the Authority at the December meeting and brought back for further <br />information. <br />Lipton noted to her, the licensee saw the patron was intoxicated and then served <br />him one beer. Others on the Authority wondered if the way it was stated, if the <br />beer was served and then the intoxication observed. <br />Lipton made a motion to order a show cause hearing for serving to a visibly <br />intoxicated person. Hughes noted he would like to hold this item over to the next <br />meeting to clarify the report even though it could be stale at that point. He noted <br />he would vote no for a show cause without clarification. Officer Redard <br />apologized for not having clarification on the specific order of service. Lipton's <br />motion for a show cause died for lack of a second. <br />Hughes moved to table both this report and the report in Item B over for the next <br />meeting to get clarification on the possible over - service. Carlson asked what the <br />link was between the two reports. Tennessen stated it was linked because <br />Henry's had been mentioned in three reports in recent months. <br />Carlson suggested writing a strongly worded letter addressing the incidents. <br />Lipton noted both incidents could use added information and in fact, any police <br />report before the Authority could fall in that category. <br />Machado agreed there was a troubling pattern, but didn't feel the second incident <br />had enough information for ordering a show cause and the order of service in the <br />first incident could be clarified at the next meeting. The second incident could <br />still be referenced if action was taken on the first incident. <br />Carlson felt the first incident was too stale and a show cause was not judicious <br />use of the City's resources. He still suggested a stern letter. <br />Hughes agreed with Machado about the second incident and was concerned <br />about a letter when there was not strong evidence of violations. He did not want <br />the purpose and impact of future letters to be diluted. He withdrew his motion. <br />Tennessen moved a letter be sent to Henry's. Carlson seconded. Roll Call Vote: <br />Tennessen — yes, Carlson — yes, Machado — yes, Lipton — yes and Hughes — no. <br />B. Incident Report — Henry's — 12/13/14 <br />Police responded to a report of a theft at the establishment. The discussion on <br />this item was included with the discussion for Item A. <br />A motion to send a letter was made and approved. Secretary Hanson asked for <br />some direction on the letter. Carlson suggested telling Henry's they had been <br />mentioned in three police reports and the Authority has concern. Tennessen <br />
