Davidson felt the homeowner's association should maintain Tract 4, the island, and that it not be dedicated to the City. He wanted the trees to be a part of the covenants rather than part of the PUD. Tom Phare, Public Works Director, stated that it should be on the PUD that there be would be no parking available on street. He suggested that Tract 4 be dedicated to the City, although landscaping would be maintained by the homeowner's association, giving the City the flexibility of the parcel being in the City hands for any future resident's wishes to amend how the street works. Davidson liked Phare's suggestion. Mayer moved that Council approve Resolution No. 43, Series 1995, approving McKinley Park Final SubdMsion Plat and Final PUD subject to there being no parking on the loop, the Mayor's language on Tract 4, making the trees a matter of covenants rather than the PUD, and limit the cost of the park to the amount of the service expansion fees collected, plus the one's provided by staffin the revised resolution. Seconded by Levihn. Davidson stated for clarification that the four additional amendments were: 1.) 2.) 3.) 4.) The trees go to the covenants. No parking on the loop. That the trees be a matter of covenants and be deleted from the PUD. Limit the cost of the park to the service expansion collected and Tract 4 be maintained by the homeowner's association. Mayer agreed, as did seconder Levihn. Levihn asked where the no parking on the loop started and ended. Phare stated it would be all the way around the loop. Leach disagreed. Davidson offered a friendly amendment that the no parking on the loop (No. 2) be subject to negotiations between staff and the developer. Mayer and seconder Levihn accepted that. Roll call was taken. Motion passed by a 6 - 0 vote with Sisk being absent. 10
