Davidson felt the homeowner's association should maintain Tract 4, the island, and that it not be <br />dedicated to the City. He wanted the trees to be a part of the covenants rather than part of the PUD. <br /> <br />Tom Phare, Public Works Director, stated that it should be on the PUD that there be would be no <br />parking available on street. He suggested that Tract 4 be dedicated to the City, although landscaping <br />would be maintained by the homeowner's association, giving the City the flexibility of the parcel being <br />in the City hands for any future resident's wishes to amend how the street works. <br /> <br />Davidson liked Phare's suggestion. <br /> <br />Mayer moved that Council approve Resolution No. 43, Series 1995, approving McKinley Park Final <br />SubdMsion Plat and Final PUD subject to there being no parking on the loop, the Mayor's language <br />on Tract 4, making the trees a matter of covenants rather than the PUD, and limit the cost of the park <br />to the amount of the service expansion fees collected, plus the one's provided by staffin the revised <br />resolution. Seconded by Levihn. <br /> <br />Davidson stated for clarification that the four additional amendments were: <br /> <br />1.) <br />2.) <br />3.) <br />4.) <br /> <br />The trees go to the covenants. <br />No parking on the loop. <br />That the trees be a matter of covenants and be deleted from the PUD. <br />Limit the cost of the park to the service expansion collected and Tract 4 be <br />maintained by the homeowner's association. <br /> <br />Mayer agreed, as did seconder Levihn. <br /> <br />Levihn asked where the no parking on the loop started and ended. <br /> <br />Phare stated it would be all the way around the loop. <br /> <br />Leach disagreed. <br /> <br />Davidson offered a friendly amendment that the no parking on the loop (No. 2) be subject to <br />negotiations between staff and the developer. <br /> <br />Mayer and seconder Levihn accepted that. Roll call was taken. Motion passed by a 6 - 0 vote with <br />Sisk being absent. <br /> <br />10 <br /> <br /> <br />
