Howard asked if there was an agreement with the neighbors on Grant Street. <br /> <br />Brisnehan felt all of the problems had been addressed. <br /> <br />Sisk felt the Grant and South Street stop sign needed to be implemented. <br /> <br />David Burrous, 924 Grant Avenue, Louisville, Colorado, stated that they are in agreement with the <br />proposals made by staff They thought a four-way stop at Grant and South would be a good idea. <br /> <br />Keany suggested painting parking stalls along the east side of Grant. He wanted his recommendation <br />as part of the approval. <br /> <br />Levihn opposed a stop sign at Lincoln and South because of the small hill there. People would <br />possibly run the stop sign and it would give a false sense of security to people walking across the <br />street. <br /> <br />Davidson summarized, taking out the one stop sign and stripping the parking spots on West Grant. <br /> <br />Davidson: So moved. <br /> <br />Sisk seconded. All in favor. <br /> <br />DISCUSSION/MOTION BELLA VISTA SOUTH SUBDIVISION - BREACH OF <br />AGREEMENT - CASH-IN-LIEU DETERMINATION <br /> <br />Paul Wood, Planning Director, stated that this Subdivision Agreement was executed by the City in <br />1980. Section 5.1 of the agreement provided that the subdivider was to meet the open space <br />dedication requirement by a 12% cash-in-lieu payment to be paid in full no later than two years from <br />the date of the executed agreement. Staff did not find any record that payment had been made. The <br />new owners of the property are seeking to reinstate improvement guarantees and move forward with <br />single family residential development. A 15% land dedication would be approximately 6,730 s.f. <br />Staff recommended a cash-in-lieu of payment at 15% of the fair market value of the property. <br /> <br />Lathrop pointed out that in 1982 the subdivider was to make that cash-in lieu of payment, but did not <br />and the City did not follow up and require it. <br /> <br />Wood stated that there was no building activity to trigger the follow-up. <br /> <br />Sisk asked if this agreement was legally still in full force and effect. <br /> <br />Susan Griffiths, City Attorney, stated that the effect of the subdivider not having made the payment <br />within the two year period had an uncertain legal effect, which is not easily addressed.
