Coda stated that there would be about $186,000, which is their 12% cash-in-lieu payment.
Mayer had $250,000 in mind for their compromise for the City not getting the land dedication.
Davidson recognized another member of the audience wishing to speak on Resolution No. 51.

Roy Garvert, 7780 Dyer Road, Louisville, Colorado, asked Council not to approve the Final
Subdivision Plat until Home Depot gives their agreement, as directed by Planning Commission and
the PC Chairman Bill Boulet, to give the property owners permanent daily access from the east to
Sterling Heights Subdivision, rather than just emergency access. Home Depot had been directed to
have a final agreement that had been approved by all of the property owners in Sterling Heights
Subdivision, which they have not done. Without this, it eliminates any possibility of selling the
acreage off of the back of the property.

Keany asked how often trucks will be parked at the four loading docks on the south end of the
building.

Coda stated that there would be two to three trailers parked there all the time, as they receive about
20 truckloads/day.

Wood stated that there would be an 8' wall on the west side of the truck well.

Levihn asked if the landscaping would be a separate plan.

Wood stated that staff is recommending that it come back to Council as a separate agreement and
approval for off-site landscaping. The on-site landscaping would be incorporated into the PUD.

Levihn suggested the entrance into the building parking lot be one-way.

Sisk asked how many square feet of signage would be allowed under the Gateway Design Guidelines.

Wood stated they would be allowed 200 s.f./building fi-ontage (anything adjacent to a street, parking
lot, or a public access). They have three building frontages, so 600 s.f.

Sisk wanted the applicants to eliminate the excess signage and have lower wattage on the exterior
lighting.

Mayer moved that Council approve Resolution No. 51, Series 1995, Final Subdivision Plat and PUD
Development Plan for Home Depot with the conditions in Resolution No. 51 with the following
amendment to conditions number:

6
