The recommendation was to approve the November 3, 1995, draft of the <br />Amendment to the Meadows at Coal Creek Subdivision Agreement and to not approve Resolution <br />No. 56, Series 1995. <br /> <br />Susan Griffiths, City Attorney, stated that the only change to the draft that had been previously <br />provided to Council appeared on page 2 with respect to the Letter of Credit for cash would be in a <br />total amount to be determined by the City no later than November 21, 1995. The subdivider had <br />agreed to obtain an appraisal from an oil and gas well appraisal person. <br /> <br />Davidson called for applicant's comments. <br /> <br />Ray Schlott, 647 Manorwood Lane, Louisville, Colorado, stated that there are five significant things <br />on the punch list: Asphalt to be installed after City approval and sufficient build-out on the lots; <br />landscaping of Outlot A; replacement of cracked concrete on sidewalks; drawing certifications, cost <br />information; install approximately three quarters of a mile of fencing along the bike path on the <br />easterly side and down under the powerline. <br /> <br />Delmer Zweygardt, 3364 Quail Ridge Circle, Parker, Colorado 80134, felt all of the problems were <br />getting resolved. <br /> <br />Davidson called for Council comments or motions. <br /> <br />Sisk moved that Council approve the Amendment to the Meadows at Coal Creek Subdivision <br />Agreement with the inclusion of a sentence on page 2 that if the City is named in any legal action, the <br />Subdivider agrees to reimburse the City for any legal expenses and any other costs incurred directly <br />by the City in defending such action. Seconded by Levihn. Roll call was taken. Motion passed by <br />a 6 - 0 vote with Lathrop being absent. <br /> <br />Davidson moved that Council deny Resolution No. 56, Series 1995. Seconded by Howard. All in <br />favor. <br /> <br />OTHER REGULAR BUSINESS ITEMS ARISING AFTER PREPARATION OF AGENDA <br /> <br />Mayer returned to the subject of Century Office Park. <br /> <br />Keany asked to be excused due to a lack of interest. <br /> <br />Davidson excused Keany. <br /> <br />Jim Junge, Planner for the project, stated that they had no issue as to consistency concerning signage, <br />with the exception of Lots 9A and 10A.
