Howard moved that Council approve Resolution No. 71, Series 1995, Final PUD Development Plan for McBride Brothers, CTC, with one condition. Seconded by Lathrop. Lathrop offered a friendly amendment to allow that rooftop mechanical equipment (maximum 6' in height) located on the warehouse structure may be painted in lieu of the provision of a screen. Howard and seconder accepted that. Sisk wanted to make sure future expansion was not a part of this. Wood assured him. All in favor with Levihn being absent. RESOLUTION NO. 72, SERIES 1995 - CONSENT TO ASSIGNMENT OF OBLIGATIONS FOR EXTENSION OF CENTENNIAL COURT FROM NEODATA TO HOMART Paul Wood, Planning Director, stated that the scope of this action is to assign an existing obligation out of Neodata's Subdivision Agreement, the item of the extension of Centennial Court (Infinite Drive), extending the deadline for construction from December 31, 1995 to August 31, 1996. Davidson called for the applicant's presentation. Don Shonkwiler, Homart Development Company, 400 South McCaslin, Louisville, Colorado, pointed out a typographical error in the Resolution to be corrected. He stated that they are assuming the obligation of Neodata to complete Infinite Drive. Jeanne Lee, Neodata Services, 833 South Boulder Road, Louisville, Colorado, stated that there will be several letters of credit in place. Davidson called for Council comments, questions, or motions. Sisk wanted to make sure that there is a letter of credit that guarantees the extension of Infinite Drive. Lee stated that Quantum has one in place and Neodata will have one in place. Shonkwiler stated that Homart was not going to issue a letter of credit. Davidson moved that Council continue Resolution No. 72, Series 1995, to the December 19 Council meeting. Seconded by Mayer. All in favor with Levihn being absent. 10
