Howard moved that Council approve Resolution No. 71, Series 1995, Final PUD Development Plan <br />for McBride Brothers, CTC, with one condition. Seconded by Lathrop. <br /> <br />Lathrop offered a friendly amendment to allow that rooftop mechanical equipment (maximum 6' in <br />height) located on the warehouse structure may be painted in lieu of the provision of a screen. <br /> <br />Howard and seconder accepted that. <br /> <br />Sisk wanted to make sure future expansion was not a part of this. <br /> <br />Wood assured him. <br /> <br />All in favor with Levihn being absent. <br /> <br />RESOLUTION NO. 72, SERIES 1995 - CONSENT TO ASSIGNMENT OF OBLIGATIONS <br />FOR EXTENSION OF CENTENNIAL COURT FROM NEODATA TO HOMART <br /> <br />Paul Wood, Planning Director, stated that the scope of this action is to assign an existing obligation <br />out of Neodata's Subdivision Agreement, the item of the extension of Centennial Court (Infinite <br />Drive), extending the deadline for construction from December 31, 1995 to August 31, 1996. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Don Shonkwiler, Homart Development Company, 400 South McCaslin, Louisville, Colorado, pointed <br />out a typographical error in the Resolution to be corrected. He stated that they are assuming the <br />obligation of Neodata to complete Infinite Drive. <br /> <br />Jeanne Lee, Neodata Services, 833 South Boulder Road, Louisville, Colorado, stated that there will <br />be several letters of credit in place. <br /> <br />Davidson called for Council comments, questions, or motions. <br /> <br />Sisk wanted to make sure that there is a letter of credit that guarantees the extension of Infinite Drive. <br />Lee stated that Quantum has one in place and Neodata will have one in place. <br /> <br />Shonkwiler stated that Homart was not going to issue a letter of credit. <br /> <br />Davidson moved that Council continue Resolution No. 72, Series 1995, to the December 19 Council <br />meeting.
