Davidson: purchases it, then there's absolutely no control that the City will have in the future. Does the Council feel that we can pursue this, perhaps two pronged approach: we're participating in this thing, because we have to, but we still are going to try to look out for the citizens of Louisville by trying to purchase it on our own, so in future we have whatever option come down the pike? Would this Council be willing to do that. It's a valid contract, unless the County backs out. Lathrop: I'm not advocating acquiring that property for commercial development. I'm advocating purchasing that property to control our destiny, to retain our options, so that we know we do have a back door, should we need it at some point down the trail. Things can happen, if you want them to happen. Hornbostel felt that Louisville is getting all of the benefits at a quarter of the price that Louisville was going to pay for it. She felt that it serves the best interest of the people in this community to do this as economically as possible. If it means working with other people in Louisville's area, she saw nothing wrong in that. Mayer: If we were a party to encouraging the Lastokas to break the agreement, what sort of remedies would the parties who currently have the contract have against Louisville? Tarloue: Conceivably, there could be some sort of claim against the City for tortious interference with contractual relationships. Mayer: Could they sue us for any costs incurred in performing the contract? Tanoue: It would be for the damages resulting to the remaining parties from Louisville's interference with the contractual relationship between 19
