is out of the barn, so to speak. I don't see how we can back out of the situation at this point. I favor open space and, at the same time, I know we need a tax base and commercial development. I'm going to favor participating in this agreement. Lathrop: Davidson: Brand: Somehow my remarks got construed as skulking around and doing something illegally. I'm not advocating that. I'm advocating that we make a concerted effort, legally, to acquire that property. I would ask that maybe we could slither over to the County and get on our knees and ask them to let us take their position in the agreement, if we choose to buy it. Maybe that would be acceptable. At this point what the County is looking for is a declaration of intent by the City. Do we intend to participate in this or not? If we did intend to participate, then I would request that the motion be "subject to terms and conditions, as negotiated for use of the ball fields" and such things as that. Tom Phare, had enclosed a memo in Council's packet with some substantial concerns about the use of the land. Could he at least refer to that and have it included in the comments, since this is a public hearing? Also, Paul Wood, Planning Director, has raised an issue that we had not thought about before. Tom Phare, Public Works Director, spoke on the memorandum (SEE ATTACHED) in Council's packet, which spoke to some of the concerns that the Public Works Department has for land adjacent to some of the City's major facilities.
