Griffiths provided to the City <br />Attorney of Lafayette and the Boulder County Attorney, who are <br />working on the documents, her understanding of the six (6) <br />matters that were identified by Louisville's City Council at <br />its last meeting. Those six (6) issues were: <br /> <br />1.) Addressing drainage <br />2.) Louisville purchasing the south portion of the property <br /> with restrictions prohibiting commercial and residential <br /> type development, but allowing Louisville to otherwise <br /> determine the use of the property. <br />3.) Stating that nothing in the agreement or purchase would <br /> limit the City's ability to expand its existing shops and <br /> Treatment Plant within the south portion purchased by <br /> Louisville. <br />4.) Discussion of the sludge issue with Lafayette to <br /> determine if some compromise is possible, so long as the <br /> use does not adversely affect the surrounding property in <br /> considering a joint project for community composting. <br />5.) Addressing the price of the south portion of the <br /> property, since it is the less valuable portion of the <br /> property. <br />6.) Acquisition by the County of other property of benefit to <br /> Louisville. <br /> <br />She stated that the other issues that are not addressed in the <br />IGA, as of yet, but were addressed at the February 2, 1993 <br />meeting were: Public access to the property; responsibility <br />for management of the area by the primary user; some method <br />for resolving differences among the parties, in a manner set <br />out in the Louisville/Superior Agreement; addressing liability <br />and insurance issues; addressing ownership issues (joint or <br />divided); specifying limitations on development; provisions <br />superseding the existing 1984 agreement; methods of handling <br />oil and gas leases, drainage issues; clear authority for <br />Louisville to annex the ball field area, identifying what uses <br />would be permitted with the ball fields, i.e., concession <br />stands, parking, lights, etc. <br /> <br />Griffiths stated that the draft documents are very preliminary. <br />She commented that, if the substantive issues that Council has <br />identified at the last Council meeting are agreed upon by the other <br />parties in some substantial fashion, then Council will see a <br />substantial revision of all of the documents. The next meeting <br />reviewing the draft documents and consider the substantive issues <br />is set for March 8, 1993. <br /> <br />Howard didn't hear mentioned the area where Lafayette was going to <br />have an equal ability to build their own ball fields on some <br />portion of that property, even though they are not going to be <br />fronting their monies for the purchase of the property up front <br /> <br />8 <br /> <br /> <br />
