Davidson:

No. They're putting in the same
money we're putting in. They have
the same rights we have. The last
thing now is that the attorney's are
going to get together and hammer
some of these things out.

REITFRN TO - DISCUSSION/DECISION ON PARTICIPATION IN NORTHERN
COLORADO WATER CONSERVANCY DISTRICT SOUTHERN PIPELINE PROJECT AND
PURCHASE OF WATER

Tom Phare, Director of Public Works, stated that the current
agreement calls for Louisville to, upon all of the contingencies
being removed, provide $109,060.00 for part of Louisville's share
of the cost of engineering, planning, environmental studies, and
other work on the project already expended by the District. There
was $197,270.00 estimated to cost for engineering from that date
forward. He expected those numbers to switch a little, but the
total would be the same. He stated that if the $109,060.00 was
prorated out from 3 c.f.s, to 4 c.f.s, which is a 33% increase,
that number would b $145,050.00. He stated that $197,270.00
prorated upward would be $262,369.00.

Mayer:

These numbers, as originally
drafted, were based on our
participation and on the understood
participation at the time. Even if
we hadn't changed our c.f.s., say,
if the overall participation had
gone up, I don't get the feeling
that that number would have gone
down.

Phare:

The project cost estimate has been
revised downward slightly. Our
agreements don't reflect it, but the
update they did was about $3.3 vs.
$3.5 million. I'm sure most of that
is in construction. If anything,
they've probably spent more money,
because they' ve had some
environmental concerns raised that
they have addressed. They have the
pipeline broken into segments based
on rational break points depending
on participation. The $109,060.00
was based on hard numbers at that
time per their accounting system for
incurred expenses. The $197,270.00
was an estimate of the engineering
expense to get to bid opening dates.

12
