2.) The drainage paragraph of the agreement needs to be <br /> addressed. Louisville has suggested that the paragraph <br /> be eliminated or redrafted. It has not, as yet, been <br /> done. <br />3.) That Louisville retain the right to terminate its <br /> approval of all of the documents, if various conditions <br /> set out in the purchase agreement are found to exist, <br /> i.e., if certain warranties of the seller are found not <br /> to be correct at the time of closing, which is proposed <br /> for approximately May 1, 1993. <br />4.) The motion would provide that Louisville's approval of <br /> the document be contingent upon Boulder County and <br /> Lafayette approving the documents in the revised form and <br /> any other conditions that the Council might wish to <br /> propose. <br />5.) If the Council would wish to do so, permitting some non- <br /> substantive revisions, as long as there is a unanimous <br /> agreement among the Mayor, the City Administrator, and <br /> the City Attorney that the revisions are non-substantive. <br />6.) There should be some consideration of the sellers <br /> concerns that have been expressed to the Boulder County <br /> Attorney and transmitted to Griffiths today (SEE <br /> ATTACHED). <br /> <br />Sisk: <br /> <br />Griffiths: <br /> <br />As I understood the memo on the <br />underground tanks, the sellers were <br />going to represent, but not warrant? <br /> <br />My understanding was that there is <br />currently a warranty. Let me check <br />that. <br /> <br />Davidson opened the Public Hearing. <br /> <br />John Waschak, 627 West Hawthorn Street, Louisville, Colorado, <br />stated that he felt that the Council had missed it by not having <br />Louisville buy the Lastoka property outright. He wanted Council to <br />approach the County and Lafayette about Louisville going ahead and <br />buying the property by themselves. <br /> <br />Lawrence Enrietto, 1000 LaFarge, Louisville, Colorado, made it <br />clear that he was speaking just for himself and his mother-in-law, <br />not for any firm or organization. He stated that this property has <br />always been considered a part of Louisville, giving some of the <br />history of the property and its owners. He commented that Susan <br />Lastoka had told him that ever since the IGA agreement has been <br />signed, Council had no idea what this agreement has done to her <br />family. He felt that the land should be valued higher than what <br />they're being paid. He would like to see the City of Louisville <br />tender a reasonable offer to the Lastoka family to purchase this <br />property, so the City of Louisville can control it and its own <br />destiny, instead of Boulder County and Lafayette. <br /> <br /> <br />
