2.) <br /> <br />3.) <br /> <br />that, if possible, the boundaries of Parcel 1 should be <br />redrawn, so as to keep it approximately 63 acres in size. <br />Griffiths reviewed a map (draft proposal), which she <br />handed out to Council, that was provided to her by the <br />Boulder County Attorney, which redraws, in a preliminary <br />fashion, Parcel 1, so that it's still 63 acres in size. <br />She commented that there are two (2) options for Parcel <br />2 and 3. Parcel 4 would still remain the 24 acres in the <br />northwest corner of the property. Boulder County asked <br />if there could be some decision from the Council at this <br />meeting, as to whether Council really wants to redraw the <br />boundaries of Parcel 1. If so, which of the versions <br />would be most acceptable? Lafayette and Boulder County <br />representatives agreed to the redrawing, which is the <br />draft proposal. <br />There was a discussion on increase in the size of the <br />ballfield size to 24 acres. Griffiths stated that the <br />comment made at the meeting of April 7, was that that <br />increase would be more than 1/3 of the purchase of Parcel <br />1, so Louisville's share of the price on Parcel 1 should <br />be correspondingly increased to reflect its actual <br />proportion relating to the 24 acres. Its share of the <br />price of Parcel 4 would be correspondingly decreased. <br />Concerning having the drainage paragraph deleted, after <br />considerable discussion at the meeting, there was a <br />request that Griffiths try to redraft the drainage <br />language, which she did. After discussions with the <br />Mayor, City Administrator, and Public Works Director, <br />they came up with some language that was sent back to <br />Lafayette and Boulder County, who sent back some changes <br />to that language. She briefly described those changes. <br />The language proposed by Lafayette originally was <br />entirely deleted and would be replaced by a declaration <br />that the parties would desire to avoid, to the extent <br />practicable, construction of major new drainage <br />facilities on the property, particularly on the northwest <br />portion of the property, which would adversely affect its <br />open space nature. Concerning the obligation of the two <br />(2) regulatory bodies over the uphill property, City of <br />Louisville and Boulder County, this paragraph in the IGA <br />requires Louisville and Boulder County to continue to <br />enforce their existing drainage regulations on the uphill <br />property and to notify each of the other parties of any <br />amendments to those drainage regulations for a period of <br />20 years, and that any amended regulations will be at <br />least as stringent in regulating drainage affecting the <br />property, as those existing at the time of execution. In <br />addition, it requires Boulder County and Louisville to, <br />in good faith, review their existing drainage regulations <br />for adequacy and for consistency with regional drainage <br />plans, policies, and procedures. It does not require <br />Louisville or Boulder County to adopt any regulation at <br /> <br />2 <br /> <br /> <br />
