Mayer stated that when Ms. Stein came forward last fall, he <br />suggested that Public Works do a study, to avoid everyone coming in <br />with their separate requests on where they want their property line <br />to be on Dahlia. He would like Council to meet with Public Works <br />to come up with a consistent policy for the whole section of <br />Dahlia. <br /> <br />Sisk agreed with Mayer, being concerned about procedure. It was <br />his understanding that requests of this nature would go to the <br />Board of Adjustment and not to the City Council directly. He <br />stated that he also voted against Dr. Stein for different reasons. <br /> <br />Paul Wood, Planning Director, stated that the encroachment is not <br />an issue of setback. It's an encroachment into the right-of-way. <br />He stated that he didn't believe the Board would have the <br />jurisdiction to address a variance, an encroachment, or a license <br />agreement issuing a right-of-way. <br /> <br />Sisk wanted to see the matter scheduled for a Work Session before <br />a decision was made. <br /> <br />Davidson suggested directing the City Engineer to go out and <br />examine the area and come back with a recommendation for all along <br />Dahlia, so the issue would be settled all at once. <br /> <br />Sisk: <br /> <br />If that's your motion, I'll second <br />it. <br /> <br />Davidson stated that it had been moved and seconded to direct the <br />Public Works Director to examine the issue on Dahlia Street and <br />come back with a staff recommendation. All in favor. <br /> <br />DISCUSSION/DIRECTION - LICENSE AGREEMENT - GERRITY OIL & GAS <br />CORPORATION <br /> <br />David Siple, Land Manager, Gerrity Oil & Gas Corporation, 4100 East <br />Mississippi Avenue, Suite 1200, Denver, Colorado 80222, stated <br />that they are requesting a revokable license agreement for an <br />existing pipeline and for a section of pipeline that they would <br />like to construct. The pipeline proposed is located along a <br />portion of the 104th Street right-of-way between Dillon Road and a <br />point one-half mile to the south. The existing pipeline is located <br />along the Dillon Road right-of-way between south 88th Street and <br />Hwy. 287. He stated that Keith Crouch, their legal counsel, had <br />been negotiating with Susan Griffiths, City Attorney, regarding an <br />Exhibit C (SEE ATTACHED) to be attached to the license agreement. <br />He stated that the ballfields would be located in the southwest <br />quarter of the northwest quarter of Section 9. He stated that the <br />ballfields would take up a good portion of the southwest/northwest <br />quarter. They proposed to move the well location to the west, so <br />that it would be no closer than 60 ft. from the east line.
