Mayer:

Brand:

Lathrop:

Brand:

Lathrop:

(INAUDIBLE), when we entered into
the Intergovernmental Agreement.

My understanding in looking at the
Agreement was that I believe
Cherryvale was going to agree, when
that was annexed, that that could go
to the Louisville Fire District and
that Hwy. 36 would become the
dividing line.

That's right, but it's not
automatic. The property owner has
to agree and the two Fire Districts
need to work it out. We don't have
to get involved.

Are we not being asked by the
Louisville Fire Protection District,
that upon annexation, that a
property will become part of the
Louisville Fire Protection District.
If that property happens to be in
another fire district, then it's
incumbent upon the property owner to
work with that other fire district
to seek exclusion? Is that what
we're being asked to do?

I'm not sure what we're being asked
to do, because when I told Bruce
Joss that the old resolution was no
longer in effect, shortly
thereafter, I got a copy of this
resolution that the Fire District
adopted. I just wanted to get it
out for discussion, because I think
it is the intention of all of the
Council members, who have been
through this before, that the city
not be involved in this again, that
it be between the property owner and
the two fire districts.

I think what the L.F.P.D. is asking
is that from this time forward, that
if we annex a property, that it be
understood and legally included
within the L.F.P.D. If it so
happens to also be within some other
fire protection district, then it is

14
