I think <br />the Intergovernmental Agreement <br />would certainly carry a lot more <br />weight than our just agreeing to do <br />this on behalf of L.F.P.D. <br /> <br />Griffiths stated for clarification that the some years ago the <br />City's Annexation Agreement required, at the time of annexation, <br />that the property be included in the Louisville Fire Protection <br />District. When all of this was going on, a part of what occurred <br />was that the standard of the Annexation Agreement was revised to <br />eliminate that language. Now, all the Annexation Agreement says is <br />the City does not services and the annexor understands that, that <br />fire protection services are provided either by the Louisville Fire <br />Protection District or the Cherryvale Fire Protection District. <br />It's up to the landowner and the Districts to determine who will be <br />providing fire protection. She explained that the city <br />affirmatively has not taken the position at this time that any land <br />annexed to the city will become part of the L.F.P.D. <br /> <br />Lathrop: <br /> <br />They are requesting that from this <br />resolution? <br /> <br />Griffiths agreed. <br /> <br />Davidson: <br /> <br />I think the reason that it's <br />probably not there anymore is we <br />cannot require the C.F.P.D. to <br />exclude land. They vote on it. <br />Therefore, we have no power to <br />enforce that. <br /> <br />Griffiths pointed out that Section 32.1.502 (2) is one of the means <br />by which property is excluded from the Fire Protection District, <br />not all of the means. <br /> <br />Mayer suggested that they tell both sides that Council will abide <br />by the IGA and its provisions. <br /> <br />Brand: <br /> <br />Is that agreeable then, just notify <br />the Louisville Fire Protection <br />District that we will abide by the <br />IGA? <br /> <br />Davidson: <br /> <br />That's the existing agreement in <br />place and they agreed to it at the <br />time. <br /> <br />15 <br /> <br /> <br />
