hearing for October 19, 1993, as amended by the acting City
Attorney. Seconded by Hedding. Roll call was taken. Motion
passed by a 5 - 1 vote with Hornbostel voting against and Howard
being absent.

ORDINANCE NO. 1123, SERIES 1993 - ZONING CERTAIN REALPROPERTY
- BEATON - 1ST READING - SET PUBLIC HEARING 9/22/93

Ross read by title only, Ordinance No. 1123, Series 1993, "An
ordinance amending Title 17 of the Louisville Municipal Code
entitled "Zoning" by zoning property owned by Timothy and Barbara
Beaton known as the Beaton annexation."

Davidson called for Council comments.

Mayer suggested that the zoning be set as RR, because if there
becomes a good reason for going to a higher density with RR zoning,
it could always be done through the PUD process. He did not want
to allow the higher density just by use-by-right.

Lathrop was concerned about going from an existing RL right to an
RR zoning. He stated that, if the size of the homes would be
commensurate with the lot sizes, it would be more appropriate for
it to be RE, which is more appropriate.

Hornbostel believed that it should be RR, as she wanted to
encourage larger lots.

Sisk thought it would be applicable to have this property as RR
zoning, with the understanding that a PUD will be coming forward.

Mayer moved that Council adopt Ordinance No. 1123, Series 1993,
zoning the .66 acre parcel as RR. Seconded by Hornbostel.

Sisk offered a friendly amendment to put this out for publication
and set a public hearing.

Mayer agreed, adding put it out for publication, set a public
hearing for October 19, 1993, and with the amended legal
description by Scott Ross, acting City Attorney, in Ordinance No.
1122, Series 1993. Seconder, Hornbostel, agreed. Roll call was
taken. Motion passed by a 6 - 0 vote with Howard being absent.

Hornbostel wanted the open space to be in addition to what is
legally required, not to be in place of a roadway. She stated
that, if they put a private drive in there, make sure the city can
plow it.

11
