provides that in the event of a court action such as <br />this, that those proceedings are held in abeyance. <br />Therefore, Williamson is recommending that Council <br />republish the public hearing. For that purpose <br />Williamson drafted Resolution #10, Series 1988, <br />which is substantially identical to the resolution <br />that Council adopted last fall. This Resolution <br />reschedules the public hearing on the Resolution <br />for March 15, 1988. <br />Sackett asked if ~5uperior has been contacted <br />regarding the decision of the Court. Hundley sug- <br />gested that proceeding as quickly as possible with <br />Resolution #10 would be advisable and that he would <br />engage in convers<~tions with Superior, if Council so <br />desired, to a seep; "win-win" solution with regard to <br />McCaslin Blvd. Sackett stated that he would hope <br />that doing what i;s best for Louisville could also be <br />good for Superior and would recommend that the City <br />engage in conversations with Superior regarding this <br />issue as it would be in both city's best interests. <br />Mayor Fauson stated that conversations were on-going <br />until the filing of the action in District Court <br />took place. From that point on, anything to do with <br />this issue was to be held in abeyance. Mayor Fauson <br />stated that he wi7L1 be talking with the Mayor of <br />Superior and also recommends adopting Resolution <br />#10 at this time. <br />Williamson read in its entirety Resolution #10, "A <br />Resolution of the City Council of the City of Louis- <br />ville finding substantial compliance of an annexa- <br />tion petition filed by George F. Menkick and Kyung <br />S. Menkick and initiating annexation proceedings for <br />certain property and establishing a time for a pub- <br />lic hearing to determine if the proposed annexation <br />complies with Stai:utory requirements." <br />Resolution #10 accepts a petition from George and <br />Kyung Menkick to annex approximately 1.8 acres of <br />land located on Mc:Caslin Blvd. across from the <br />Biella/Menkick annexation and sets a date for a <br />public hearing. T'he public hearing has been set for <br />March 15, 1988, at: 7:30 p.m. at the Louisville City <br />Council Chambers, 749 Main Street, Louisville, <br />Colorado. <br />Mohr moved that Resolution #10, Series 1988, be <br />adopted. Carnival seconded.
