ORDINANCE #949 - COAL CREEK RANCH ZONING - <br />PUBLIC HEARING Ordinance #949, "An Ordinance amending Title 17 of <br />the Louisville Municipal Code entitled "Zoning" by <br />zoning property commonly known as the Coal Creek <br />Ranch." Proper pL~blication and notice of public <br />hearing were established. <br />Mayor Fauson opened the public hearing and asked <br />that this item be continued until the February 16, <br />1988 meeting. <br />Szymanski moved that the public hearing for <br />Ordinance #949 be continued to the February 16, 1988 <br />Council Meeting. Scarpella seconded. By Roll Call <br />Vote, the public hearing on Ordinance #949 was <br />continued to the February 16, 1988 Meeting. The <br />Vote was 5-0-2 with Anderson and Sackett previously <br />excused from the proceedings. <br />(Anderson and Sackett rejoined the meeting.) <br />A & W REQUEST - TEMPORARY <br />SIGN Wanush explained ghat Mr. Mossoni is opening an A&W <br />Family Restaurant :in Centennial Center on Cherry <br />Street and is requesting a permit to place a sign on <br />U.S. 36. Section 17.24.070D of the Louisville <br />Municipal Code states: "Signs shall be permitted <br />only on the same lot or lots of the permitted <br />advertised use and only where clearly incidental, <br />customary or commonly associated with the operation <br />of the permitted use." Mr. Mossoni is requesting <br />that a temporary s~tgn be allowed for 120 - 240 days. <br />He is basing his request on the fact that the <br />ordinance does allow off premise signs for <br />subdivisions that a.re in the process of building <br />out. <br />Given the present ordinance, the tyge of sign that <br />he is requesting is not permitted and Council is not <br />authorized to grant exceptions. If the Council <br />wishes to consider Mr. Mossoni's request, it must be <br />in the form of an amendment to the sign code and <br />this type of amendment would start with the Planning <br />Commission. Staff is seeking direction from Council <br />on whether such a change in the sign code should be <br />contemplated. <br />Mr. Mossoni thanked Council for this opportunity to <br />consider his requesi~ as outlined by Mr. Wanush. <br />Williamson stated that as Wanush explained, the <br />City's Code does not provide for any variances to <br />the sign code, temporary or otherwise. Therefore, <br />this would have to be done through an amendment to <br />the sign code which would need to be referred to the <br />4 <br />
