Williamson stated thhat this is a unique situation <br />for Louisville. Other cities have adopted a full <br />permit process by ordinance with these types of <br />standards and restrictions imposed within the <br />ordinance. Williamson suggested that if this is a <br />"one of a kind" it may not be worth drafting an <br />ordinance. However, if several other businesses <br />of this type are requested it would be in the <br />City's best interest: to draft such an ordinance. <br />Wanush suggested that two locations be defined and <br />other locations be reported to staff to assess any <br />possible problems. This would allow staff to <br />analyze the need for- future regulations based upon <br />experience. This ~>ermit could be for a limited <br />amount of time, po:asibly just to the end of the <br />calendar year. That: way it could be reassessed to <br />see what, if any, problems might need to be looked <br />at. <br />Mayor Fauson stated that he felt some of these <br />things could be handled administratively and any <br />problems brought back to Council for appropriate <br />action. Mayor Fauson felt that having the cart in <br />the downtown area would be appropriate provided <br />that the cart is not located in front of the <br />restaurants. <br />Williamson recommended that Council only approve a <br />temporary permit s~o that if Council decides to <br />adopt a general ordinance pertaining to this type <br />of permit, Ms . PaquE~t would need to comply to the <br />terms of that ordir.~ance . Length of time at any <br />particular location should be considered by <br />Council along with ~opecific locations. <br />A concern of Carnival's was competing with <br />concessions at the ballfields provided by the <br />voluntary organization of parents of Little League <br />to raise money for i~he League. Lillo stated that <br />he has contacted people connected with that <br />operation. Until they have an opportunity to see <br />how this operation works out, it is difficult to <br />assess any concerns. Lillo felt that if her sales <br />are complementary ~to what is being sold at the <br />concession stand, :it probably won't be a major <br />problem. Likewise, having the cart at Memory <br />Square would be a complement to the sales of candy <br />and pop at the pool. Carnival asked that Ms. <br />Paquet be sensitive to this issue and focus on <br />adult softball programs. <br />Ms. Paquet stated that it is not her intention to <br />compete with volunteer organizations and she would <br />not only be sensitive to this, but would be in <br />11 <br />
