constant contact with the Director of Community Services to check the schedule of games at the ballfield. Anderson moved and Carnival seconded to approve the operation of the mobile vending cart with the following restrictions: 1) the cart will in no way block sidewalks or other rights-of-way; 2) the cart will not locate directly in front of any restaurant while it is open for business; 3) the cart will be allowed to operate on Main Street from South Street to Pine Street; 4) the design of the cart be approved by the Community Development Department; 5) t:he hours of operation be restricted from 11:00 a.m. to 8:00 p.m. six days a week, Mondays thru Saturdays; 6) the operation meet the requirements of the Boulder County Health Department standards; 7) provide proof of liability coverage :naming the City as co-insured; 8) obtain a sales and business license in the City of Louisville, and 9) activities in the City's parks be scheduled through the Department of Community Services and approved administratively. Carnival seconded the motion. Mayor Fauson stated that in terms of restrictions, if at any time it is deemed appropriate any of these restrictions could be eliminated or others imposed. Mayor Fauson and Anderson both spoke to the issue to having this operation competing with voluntary organizations. Anderson stated that restricting any private enterprise would be inappropriate. Mayor Fauson stated that there is a place for private enterprise and volunteer organizations. Mayor Fauson stated that Ms. Paquet will need to charge enough money to make a living, where the volunteers could out-sell her because their time is volunteered. This operation wouldn't be a handicap to the volunteers; the volunteers could be a handicap to Ms. Paquet's operation. Sackett stated that he is against this type operation happening in downtown. "I think it is a good idea at the ballfield, but I just think its not an appropriate u.se in the downtown area." The motion passed 5-1 with Sackett voting no.
