constant contact with the Director of Community <br />Services to check the schedule of games at the <br />ballfield. <br />Anderson moved and Carnival seconded to approve <br />the operation of the mobile vending cart with the <br />following restrictions: 1) the cart will in no <br />way block sidewalks or other rights-of-way; 2) the <br />cart will not locate directly in front of any <br />restaurant while it is open for business; 3) the <br />cart will be allowed to operate on Main Street <br />from South Street to Pine Street; 4) the design of <br />the cart be approved by the Community Development <br />Department; 5) t:he hours of operation be <br />restricted from 11:00 a.m. to 8:00 p.m. six days a <br />week, Mondays thru Saturdays; 6) the operation <br />meet the requirements of the Boulder County Health <br />Department standards; 7) provide proof of <br />liability coverage :naming the City as co-insured; <br />8) obtain a sales and business license in the City <br />of Louisville, and 9) activities in the City's <br />parks be scheduled through the Department of <br />Community Services and approved administratively. <br />Carnival seconded the motion. <br />Mayor Fauson stated that in terms of restrictions, <br />if at any time it is deemed appropriate any of <br />these restrictions could be eliminated or others <br />imposed. <br />Mayor Fauson and Anderson both spoke to the issue <br />to having this operation competing with voluntary <br />organizations. Anderson stated that restricting <br />any private enterprise would be inappropriate. <br />Mayor Fauson stated that there is a place for <br />private enterprise and volunteer organizations. <br />Mayor Fauson stated that Ms. Paquet will need to <br />charge enough money to make a living, where the <br />volunteers could out-sell her because their time <br />is volunteered. This operation wouldn't be a <br />handicap to the volunteers; the volunteers could <br />be a handicap to Ms. Paquet's operation. <br />Sackett stated that he is against this type <br />operation happening in downtown. "I think it is a <br />good idea at the ballfield, but I just think its <br />not an appropriate u.se in the downtown area." <br />The motion passed 5-1 with Sackett voting no. <br />REQUEST FOR FUNDING FOR RAILROAD <br />CROSSINGS Phare explained thai: staff was directed during a <br />recent Council Study Session to proceed to <br />identify possible funding sources that would allow <br />the replacement of the South Boulder Road railroad <br />12 <br />
