APPROVAL OF EASEMENT AGREEMENT - <br />THEDE The Thede property located at 945 Lincoln has an <br />alley and water line encroaching on the north <br />property line. The City and Thede have formulated <br />an agreement which transfers ownership of the <br />alley right-of-way and water line right-of-way to <br />the City. As part of the agreement, the City will <br />deed the two rights-of-way back to Thede should <br />South Street be constructed along the north <br />property line of the Thede's Lot (abandoning the <br />alley) and if the water line is moved north to the <br />future South Street right-of-way. <br />Mayor Fauson moved and Anderson seconded to <br />approve the Thede Easement Agreement. The motion <br />passed 7-0. <br />TEMPORARY USE PERMIT - TROUSIL PROPERTY - ST. VRAIN LANDSCAPING - <br />PUBLIC HEARING Stahl introduced the request by St . Vrain <br />Landscaping for a Temporary Permit in lieu of one <br />previously approved for the McCaslin/ Via Appia <br />location. Planning Commission reviewed the <br />Temporary Permit request and recommended approval. <br />McGuire explained tY:iat St. Vrain was applying for <br />a Temporary Use Permit to locate on a portion of <br />the Trousil property to sell landscaping <br />materials. The site' is approximately an acre off <br />County Road 62 (Empire Road), between the paint <br />factory and the City Yards. Access to the property <br />will be off of County Road where a culvert <br />provides access over the existing ditch. The <br />culvert will be improved or replaced to <br />accommodate semi-truck traffic. The site will be <br />fenced on three sides (north, east and west) with <br />a gate on the south at the ditch crossing. <br />Fencing will be of horse wire variety to provide <br />security. Fencing adjacent to the City property <br />line will be off-set to allow for the City to move <br />their fence to the west property line should such <br />an occurrence be desirable. <br />Water, electric, and phone service will be <br />extended to the site. Water will be provided by a <br />yard hydrant to be run from the water line serving <br />Trousil's building,. Office space will be in a <br />modular unit. Sanitation will be provided by a <br />portable facility (san-o-let) tied down on a <br />concrete pad. <br />Marketed materials will be cached in small piles <br />20-30 yards each. Applicant will be responsible <br />for weed control bestween lot and ditch. Stock <br />pile must be kept clear from ditch to avoid <br />intrusions.
