any type of aircraft including gliders, balloons, <br />helicopters, fixed winged aircraft, except <br />emergency aircraft, without the expressed consent <br />of the City Counci]_ or its designee. The <br />Ordinance also includes an emergency clause in <br />order that the potE~ntial exposure to danger can be <br />minimized. <br />Mayor Fauson stated'. that although this is not a <br />public hearing, Mr. Jon Sawyer asked to speak to <br />this issue and the Mayor will grant him the <br />opportunity to speak to Council. <br />Mr. Sawyer, 96 Eliot Lane, Golden CO, stated that <br />he is the pilot in question. Mr. Sawyer stated <br />that he feels this is an issue between he and Mr. <br />Stahl as there have been no complaints from the <br />public regarding his occasional landing of an <br />aircraft within the Louisville City boundaries. <br />Mr. Sawyer stated that he has proposed to land his <br />aircraft on private land which is actually a farm. <br />Crop dusters are also using this land and it is <br />Mr. Sawyer's opinion that this Ordinance would <br />preclude these crop dusters from using this land. <br />Also, Mr. Sawyer stated that there is a provision <br />within the proposed Ordinance that speaks to <br />taxiing and he feels it is unreasonable. <br />Mr. Sawyer stated that Broomfield had a similar <br />ordinance that they repealed because they found <br />that they were viol<~ting the FCC Authority within <br />the air, and Mr. Sacayer feels that Louisville will <br />run into a similar problem. <br />Mr. Sawyer stated, "'I see nothing wrong with the <br />fact that in the course of my business at the <br />Colorado Tech Cente~° that I occasionally, I'm <br />talking about three times in a four month period, <br />land my plane in a f'armer's field whose permission <br />he has received. It: is very convenient for me. <br />It enhances my ability to do business at <br />Television Technoloc~y and it poses no danger to <br />anybody. Considering the activities there that <br />are already present in that field with the crop <br />dusters and the RC controlled airplanes, it <br />doesn't represent ar.~ything more risky than whats <br />already occurring. Both the FAA and the courts <br />have basically agreed with me that this activity <br />isn't particularly dangerous. I am insured at <br />about one million dollars. I want to make an <br />offer to the City tc~ work out some arrangement to <br />indemnify the City in the potential case of <br />lawsuit. My insurance carrier is more than <br />willing to work on this case." <br />6 <br />
