Mayor Fauson stated that Council could call an <br />Executive Session wherein the city attorney would <br />then serve as Council's legal advisor. <br />Mohr moved that Council approve an amendment to <br />Ordinance #924, Section 3, entitled "Enforce- <br />ment", Paragraph E, that would state, "In the <br />event that the District Court determines that <br />either the City officials or the complainant acted <br />in bad faith or that the complaint was groundless <br />and frivolous, the District Court in its <br />discretion may awaz-d court costs, reasonable <br />attorney fees, and costs of investigation to the <br />prevailing party." Mayor Fauson seconded. <br />Unanimous. <br />Mohr then moved that Council approve an amendment <br />to Ordinance #924, Section 4, entitled "Advisory <br />Opinions", that would state, "In the event any <br />public officer or employee is uncertain as to the <br />applicability of an,y provisions of this Code to a <br />particular situation, or as to the definition of <br />terms used in this Chapter, the employee or <br />officer may apply in writing to the City <br />Prosecuting Attorney for an advisory opinion. The <br />officer or employee shall have the opportunity to <br />present his interpretation of the facts at issue <br />and of the applicability of the provisions of this <br />Chapter before sucri advisory opinion is made." <br />This would be Section 4 in its entirety. Mayor <br />Fauson seconded. Unanimous. <br />Szymanski moved that Ordinance #924 be approved as <br />amended. Mohr seconded. By Roll Call Vote, <br />Ordinance #924 was adopted unanimously. <br />ORDINANCE #925 - ZONING CHANGES - <br />1ST READING Rautenstraus read key title only Ordinance #925, <br />"An Ordinance amending Chapter 17.72 of the <br />Louisville Municipal Code concerning uses <br />permitted in Commercial Office Planning Areas in <br />Planned Community Zoned Districts, an Declaring an <br />Emergency." Permission is being sought to place <br />the Ordinance out for publication and a public <br />hearing set for February 17, 1987. <br />Hundley stated that; one of Council's strategic <br />objectives is a goal to improve Louisville's <br />commercial/economic base and identify and remove <br />any unreasonable barriers to allow positive growth <br />in Louisville.
