Wanush stated that in <br />looking at City ordinances relative to this site, <br />staff could not find a provision that would allow <br />control on the site as a whole. City ordinances <br />do allow for preliminary PUD's, in this case, the <br />Health Park, and provide for final PUD's on the <br />development of individual pieces within the pro- <br />ject site such as the Boulder Psychiatric <br />Institute (the next Agenda item). <br />Dave Stahl, 400 So. McCaslin Blvd., project <br />manager for Homartt, related certain concerns on <br />the issue of the Subdivision Agreement with Health <br />Park and asked for clarification on three issues: <br />1) will recovery fees for water taps be going to <br />the Homart Development Co. or the City of <br />Louisville and exactly what that amount will be; <br />2) regarding sewer fees - how was the $160,855 <br />figure derived and. is the money thats being paid <br />up-front to the City going to be recovered to <br />Homart inasmuch as; the City has no commitment or <br />interest in the line that exists today; and 3) <br />the question of responsibility of improvements to <br />Dillon Road west of the intersection at 88th <br />Avenue. Homart is obligated to widen Dillon Road <br />to four lanes as traffic warrants. At the time <br />Homart negotiated their Agreement with the City, <br />there was no contemplated commercial or health <br />care parks that would generate traffic in that <br />area. Stahl asked, "If in fact these facilities <br />do generate sufficient traffic to require the <br />widening and Homart has not created that traffic, <br />are we in fact obligated to widen that road?" <br />Mohr stated that he is truly enthused and excited <br />about the Health Park. However, there are aspects <br />of the Agreement that concern him. Mohr suggested <br />that not having some type of master plan on this <br />project is creating a level of discomfort and <br />would like to look into how long it would take to <br />go through the process of changing the current <br />code to include projects of this size. <br />Mohr asked several questions regarding sections of <br />the Agreement, specifically improvements to South <br />88th and Dillon Ro<~d, raw water acquisition, <br />landscaping along South 88th, "cash in-lieu of" <br />land dedication (the appraised value of land <br />zoned Agricultural as opposed to the appraisal of <br />land zoned commercial, etc)., payments for utili- <br />ties at 25$ increments (of total usable square <br />footage), building height, and signage. <br />7 <br />
