appointment to the ]Louisville Historical Commission
to serve out Mr. Urnovitz's term which expires in
January of 1988. M:r. Buffo has been very active in
the historical museum restoration project and has
donated countless hours toward its restoration. Mr.
Buffo's interest in Louisville history and its
preservation makes :him an ideal candidate for
appointment to the Commission.
Mayor Fauson moved to appoint Bill Buffo to the
Louisville Historical Commission to serve out Mr.
Urnovitz's term. S:~ymanski seconded. Unanimous.
ORDINANCE #932 - RIGHT-OF-WAY VACATION - SARATOGA II -
PUBLIC HEARING Rautenstraus read by title only Ordinance #932, "An
Ordinance vacating a portion of a pedestrian right-
of-way located in Saratoga Second Filing." Proper
publication and notice of public hearing were
established and Mayor Fauson opened the public
hearing.
Wanush stated that i:he property owners on either
side of this pedestrian right-of-way are requesting
it be vacated. Originally, the full 20' were needed
for a walkway and an open drainage channel. The
final Via Appia stoz•m drainage study outlines a
preferable alternative, so this area is no longer a
drainageway. Staff recommended that rather than
eliminating the righit-of-way, it be reduced in width
from 20' to 10' and McStain would still put in the
sidewalk. Planning Commission voted to vacate the
easement on each side by five feet and maintain a
10' right-of-way with a walkway to be designed in
the future and to be designed with safety features
in insure that bicycle traffic is not necessarily
involved with Via Appia.
Bruce Allen, 897 Cleveland Court, asked that Council
consider vacating the entire right-of-way. He
stated that residents in the neighborhood were
concerned with children using a path that lets out
onto Via Appia where motorist often drive faster
than the posted 35 mph.
Lynn Shook, 984 Cleveland, stated that the petition
submitted to Council reflected the concerns and
opinions of that neighborhood and asked that the
entire right-of-way be vacated.
Council discussion involved issues of safety,
maintenance and City policy regarding this type of
right-of-way. Mohr offered an amendment to the
Ordinance which would vacate the entire right-of-way
but to retain a ten foot easement for utility pur-
poses, including all rights to maintain, replace and
2
