The current license expires <br />August 20, 1987. <br />Ferris explained that renewal applications are sent <br />to liquor licensed establishments 60 days prior to <br />expiration. The application clearly states that it <br />must be submitted to the local licensing authority <br />no later than 45 da:y prior to license expiration for <br />approval. This requirement can be waived by the <br />local licensing authority. If a license is not <br />approved prior to e:piration, the applicant must <br />apply for a new license and have it reviewed as a <br />new license which includes processing fees of $450, <br />a public hearing, posting, publishing and petitions. <br />The establishment i:a without a liquor license during <br />that period of time, probably a period of 45-60 <br />days. <br />The applicant is requesting Council waive the 45 day <br />requirement for filing and asks that Council approve <br />the renewal applicai~ion. <br />Mrs. Patricia Stephens addressed Council stating <br />that she hoped Council would look favorably upon <br />approval of this license. <br />Anderson stated that: in looking over incidents that <br />occurred at the tavesrn over the last year, several <br />of them are of a serious nature and establishing an <br />undesirable inf luenc:e in the community. Anderson <br />asked what steps Mr:~. Stephens would take to improve <br />the problem of serious incidents happening at this <br />establishment. <br />Mrs. Stephens stated that she is in the process of <br />hiring responsible people and would welcome a review <br />of the license on some type of schedule that Council <br />may choose. Mrs. Stephens has not been managing the <br />establishment onsite herself. <br />Anderson stated that: the incidents are serious <br />enough in his mind t:o cause the license to not be <br />renewed. Anderson feels that if Council chooses to <br />renew the license tonight that it should at least be <br />reviewed quarterly. <br />Rautenstraus stated that Council has the ability to <br />call any license up for review at any time it <br />chooses. Based on the monthly reports that Council <br />currently receives from the Public Safety <br />Department, Council can decide whether to cause a <br />hearing regarding the appropriate conduct of any <br />licensed establishment. <br />7 <br />
