All <br />appropriate fees have been paid and the application <br />and pertinent documents are in order. Background <br />checks have been completed satisfactorily. <br />Mayor Fauson opened the public hearing and asked the <br />applicant for a presentation. <br />Mr. Hayden spoke to Council asking for favorable <br />consideration of his Restaurant Liquor Application. <br />Mayor Fauson asked for anyone wishing to speak <br />either in favor of or in opposition to the granting <br />of this license. None. <br />Mayor Fauson closed the public hearing and called <br />for a motion. <br />Mohr moved that Cousncil approve the application for <br />a restaurant liquor license for Gentleman Jim's <br />Restaurant. Mayor Fauson seconded. By Roll Call <br />Vote the motion was approved unanimously. <br />ORDINANCE #934 - RIGHT-OF-WAY VACATION - EVANS CIRCLE/CROWN CIRCLE - <br />PUBLIC HEARING Rautenstraus read by title only Ordinance #934, "An <br />Ordinance vacating a portion of a right-of-way <br />located in Louisville North First Filing." <br />Mayor Fauson opened. the public hearing and <br />certification of publication and public notice was <br />established. <br />Wanush stated that seven property owners contiguous <br />to this right-of-wa.y are requesting it be vacated. <br />Staff was unable to determine the original <br />justification for this strip being retained by the <br />City and could see no reason for retaining <br />ownership although easement on this property should <br />be maintained. At the July 29th public hearing, <br />Planning Commission voted to approve the right-of- <br />way vacation with :staff's recommendation that an <br />easement be maintained as required by Public Service. <br />Mayor Fauson asked for anyone wishing to speak <br />either in favor of or in opposition to this <br />Ordinance. None. <br />Sackett voiced concern regarding an impression that <br />residents may have as to their ability to acquire <br />land in this manner.. Wanush stated that a test used <br />to determine appropriateness would be "is there a <br />public purpose being served by maintaining that <br />public ground."
