The Planning Commission held a public hearing <br />concerning this on May 13, 1986 and approved the <br />annexation with the following conditions: 1) The <br />developer agrees to provide through a letter of <br />credit or other means acceptable to the City, an <br />up front payment of $32,958 to cover the deficit <br />water requirements for the project. Each water <br />tap would be reduced by $824 as a rebate for this <br />payment; 2 ) No more' than 10 building permits be <br />issued per year; 3) No building permits be issued <br />until the Public Works Department is satisfied <br />that there will be no deterioration in pressure <br />for existing customers; 4) The existing units <br />should be charged a. service expansion fee of $2.25 <br />per s.f. up to a maximum of $5,000; 5) All <br />existing water rigYits be dedicated to the City; 6) <br />The property must k>e developed as a PUD; 7) The <br />conceptual land use and access plan will be the <br />basis for approval of all subdivisions and PUD's <br />in the Spruce Lane Area. <br />Mayor Fauson moved that Ordinance #896 be put out <br />for publication and a Public Hearing be set for <br />June 16, 1986. Anderson seconded Unanimous. <br />ORDINANCE #897 - ZONING REQUEST - PROUTY, JOSEPH, <br />FIECHTL - 1ST READING Rautenstraus read by title only Ordinance #897, <br />"An Ordinance amending title 17 of the Louisville <br />Municipal Code of the City of Louisville Entitled <br />"Zoning" by zoning property of approximately 22.27 <br />acres owned by Spruce Street Fiechtl, Limited, <br />Spruce Street Joseph, Limited and Jonathan prouty <br />annexed to the City by Ordinance No. 896." <br />Permission is being sought to put the Ordinance <br />out for publication and a Public Hearing set for <br />June 16, 1986. <br />Wanush explained that this zoning request follows <br />the annexation request of the prior agenda item. <br />The request is for Rural Residential (RR) zoning <br />which has a minimum lot area of 20,000 s.f. <br />Planning Commission recommended that this be <br />approved at their Public Hearing on May 13, 1986. <br />Mayor Fauson moved that Ordinance #897 be put out <br />for publication and a Public Hearing be held on <br />June 16, 1986.
