Ltd is the owner of a 2.5 acre parcel of <br />ground currently in. the County and zoned Suburban <br />Residential (SR). They requested annexation <br />to the City with Residential Low Density (RL) <br />zoning classification. The property is located in <br />the northeast corner of the area known as the <br />Spruce Lane Neighborhood. At the May 13th Public <br />Hearing, the Planning Commission approved the <br />annexation yet denied the proposed RL zoning and <br />recommended RE zoning with the following <br />conditions: 1) The developer agrees to provide <br />through a letter of credit or other means <br />acceptable to the City an up-front payment of <br />$20,340 to cover the deficit water requirements for <br />the project. Each water tap would be reduced by <br />$1356 as a rebate for this payment; 2) No building <br />permits be issued until the Public Works <br />Department is satisfied that there will be no <br />deterioration in water pressure for existing <br />customers; 3) All water rights be dedicated to the <br />City; 4) The property must be developed as a PUD; <br />5) No land should bE~ dedicated to the City. A <br />cash payment should be required, however, equal to <br />12$ of the land value. <br />Mayor Fauson moved that Ordinance #898 be put out <br />for publication and a Public Hearing be set for <br />June 16, 1986. Unanimous. <br />ORDINANCE #899 - ZONING REQUEST - WIGGETT - <br />1ST READING Rautenstraus read by title only Ordinance #899, <br />"An Ordinance amending Title 17 of the Louisville <br />Municipal Code of the City of Louisville entitled <br />"Zoning" by zoning property of approximately 2.49 <br />acres owned by W.H.P., Limited, annexed to the <br />City By Ordinance No. 898." Permission is being <br />sought to place the Ordinance out for publication <br />and a Public Hearing be set for June 16, 1986. <br />Wanush explained that the request for Residential <br />Low Density (RL) has; a minimum lot area of 7,000 <br />s.f. Planning Commission approved the annexation <br />yet recommended RE zoning rather than the <br />requested RL zoning. <br />In reference to a question by Anderson regarding <br />the RL zoning outlined in the Ordinance, <br />Rautenstraus stated that an amendment to the <br />Ordinance at the time of adoption could be done or <br />simply vote the Ordinance down in which case it <br />is required to have the property zoned within 90 <br />days of annexation. <br />12 <br />
