Mayor Fausan moved that Ordinance #899 be put out <br />for publication and a Public Hearing be set for <br />June 16, 1986. Scarpella seconded. Unanimous. <br />ORDINANCE #900 - REZONING REQUEST - METZ <br />1ST READING Rautenstraus read by title only Ordinance #900, <br />"An Ordinance amending Title 17 of the Louisville <br />Municipal Code of t:he City of Louisville entitled <br />"Zoning" by rezoning a parcel of property located <br />within the City of :Louisville south of Pine <br />Street adjacent to Saratoga Subdivision owned by <br />W.H.P., Limited." Permission is be sought to <br />place the Ordinance out for publication and a <br />Public Hearing be set for June 16, 1986. <br />Wanush explained that W.H.P. Ltd is the owner of a <br />2 acre parcel annexed in 1982 and currently zoned <br />RE. The property is within the City limits of <br />Louisville and is located south of Pine Street, <br />west of the Corrigan Subdivision and north of the <br />Saratoga I Subdivision. Without a PUD, through <br />subdivision, the maximum allowable units would be <br />seven under the existing zoning. They have <br />requested rezoning of the property from RE to RL. <br />The maximum allowable number of units under the RL <br />zoning would be 12. Planning Commission <br />recommended denial of the rezoning at the May 13th <br />Public Hearing. However, Wanush recommends that <br />the Ordinance be sei: out for publication and a <br />public hearing be held on June 16, 1986, at which <br />time Council can decide whether to approve or deny <br />the Ordinance. <br />Szymanski felt that the Planning Commission's <br />reasons for denial were valid and was not in favor <br />of holding another Public Hearing and should not <br />be put out for publication. <br />Rautenstraus agreed that technically Council would <br />not have to set a public hearing on this matter. <br />However, it is his Y•ecommendation that Council <br />hold a public hearing, as he has applied to the <br />City and paid his money with respect to the <br />application. Rauter.~straus stated that he "feels <br />more comfortable if a decision is made on an <br />issue after there is testimony given relative to <br />both sides ]based upon the facts presented as part <br />of the record." <br />Applicant Jon Prouty, 844 W. Spruce St., addressed <br />Council with a history of his rezoning efforts and <br />urged Council to consider the rezoning. <br />13 <br />
