Anderson stated that he supports this Ordinance <br />and could see immediate results as it might have <br />been useful in an incident wherein a telephone <br />bomb threat was made to several Louisville <br />schools. This system could have identified <br />instantly where the call was coming from and who <br />was making the call. <br />Mayor Fauson closed the public hearing and called <br />for a motion. <br />Anderson moved that Ordinance #922 be adopted. <br />Mohr seconded. By Roll Call Vote, Ordinance #922 <br />was adopted unanimously. <br />APPROVAL OF HAMMING SPECIAL REVIEW USE <br />AGREEMENT Wanush explained that a building permit was issued <br />to Mr. Hamming in error. Upon receiving this <br />permit, Mr. Hamming made significant improvements <br />to the structure. Mr. Hamming was asked to come <br />through the Special Review Use process, normally <br />used for the area in which his business is zoned <br />CN. <br />Wanush explained that the Hamming Special Review <br />Use was approved by Resolution #34 on July 1, <br />1986. The agreement was never signed by Mr. <br />Hamming since he claimed several provisions were <br />too restrictive. After meeting with Mr. Hamming <br />and his attorney, staff recommended that the <br />agreement be modified by the following: 1) the <br />sign be permitted to be illuminated until 10:00 <br />p.m. rather than 6:00 p.m.; and 2) the Special <br />Review Use approval shall include approval of all <br />business or professional offices (excluding <br />medical or dental clinic s and small animal <br />clinics). City Attorney, Curt Rautenstraus, <br />reviewed and supports this recommended change. <br />Limited parking was a main consideration by the <br />Planning Commission in limiting the uses of the <br />the buildings according to Wanush. <br />Szymanski asked if small animal clinic. was to be <br />included or excluded in the agreement <br />modifications. Wanush stated that it should be <br />included. Szymanski moved that this be amended <br />in the agreement to include small animal clinics. <br />Anderson seconded. Unanimous. <br />Wanush stated that notices where sent out to area <br />residents advising them of the changes to the <br />agreement and inviting them to call or come to <br />tonight's meeting. <br />4 <br />
