She asked that Council <br />consider it a separate motion. <br />Fauson said he would not be able to support the <br />resolution without these amendments. <br />After further discussion, the motion to amend the <br />resolution and its second were upheld. <br />Council voted to adopt the amendments to <br />Resolution #18 by 4-2 with Morris and Johnson <br />voting no. <br />Resolution #18 as amended was adopted unanimously. <br />RESOLUTION #19 - <br />PIUTE ENERGY SPECIAL <br />REVIEW USE Rautenstraus read :in its entirety Resolution #19, <br />"A Resolution approving the Special Review Use for <br />Piute Energy Compar~y. " <br />Wanush related that the Planning Commission <br />approved a Special Review Use for Piute Energy <br />Co., allowing them. to construct a gas production <br />well on the Homart property. The well already <br />exists and was drilled under a prior special <br />review use. The use is permitted per Chapter <br />17.68 of the City Code. The Planning Commission <br />approved the use with the following conditions: <br />1) The point of intersection of the access road <br />and McCaslin Blvd. must be approved by the <br />Department of Public Works, 2) Drainage and runoff <br />plans must be approved by Public Works, 3) A <br />cattle guard and gate must be provided on the <br />access road, 4) The access road must be <br />constructed to standards approved by Public Works. <br />In addition, at such time as the City is prepared <br />to construct the bike trail along the ditch, Piute <br />Energy should maintain the portion of the trail <br />that coincides with the access road. Any damage <br />to the trail caused by the usage of heavy trucks <br />will be the responsibility of Piute. An agreement <br />spelling out these responsibilities should be <br />executed by Community Services. <br />Wanush ask that in addition to the above <br />conditions, that one other be added. That is the <br />location of the road must also be approved by <br />Public Works. The absolute best point to <br />construct this road has not yet been determined. <br />7 <br />
