Rautenstraus explained that by law this ordinance needs to be passed incorporating the lease- purchase agreement for the City Shops with Security Pacific which has been approved by Council previously. Mayor Meier opened for Public Comments to Ordinance #872. Mayor Meier closed that Ordinance #872 seconded. By ro 11 unanimously. ORDINANCE #873 - SCHREITER SUBDIVISION ROW VACATION - PUBLIC HEARING the Public Hearing and asked in favor of or in opposition None. the Public Hearing and moved by approved. Johnson call vote Ordinance #872 passed Rautenstraus read by title only Ordinance #873, "An Ordinance vacating a right-of-way located along the western boundary of the Schreiter Subdivision." Proper notice of the Public Hearing was published. Wanush exlplained that the property owner at 444 County Raad has requested the right-of-way described in the ordinance be vacated. The vacation is necessary for proposed development in the subdivision request (two single family units rather than four condominiums) which will be presented to Council at a later date. Planning Commission recommended approval as did staff. Mayor Meier open the Public Hearing and asked for Public Camments in favor of or in opposition to Ordinance #873. None. Mayor Meier closed the Public Hearing and moved that Ordinance #873 be approved. Cussen seconded. Ordinance #873 was approved unanimously by roll call vote. ORDINANCE #874 - CREATING CIP FUND FIRST READING Rautenstraus read by title only Ordinance #874, "An Ordinance amending Title 3 of the Louisville Municipal Code creating a Capital Improvements Fund and Merging the Service Expansion Fund, Parks and Recreation Fund and Major Thoroughfare Fund into the newly created Capital Improvement Fund." Permissian from Council is being sought to put the ordinance out for publication and a Public Hearing be set for December 3, 1985. 4
