1) Kennedy Avenue to be connected to Washington <br />Avenue as a residential street with final design <br />to be approved by Public Works and Community <br />Development; 2) Via Appia to be completed to <br />McCaslin by September, 1986; 3) Staff supports the <br />commercial move of the 7 acres but would stipulate <br />no permits to be obtained on this until 50~ of the <br />dwelling units in the entire Master Plan area are <br />completed. All commercial development is to be <br />limited to uses that are reasonably necessary to <br />efficiently serve residents of the Master Plan <br />area; 4) All land that is to be dedicated to the <br />City must be constructed to City standards. No <br />open space land will be accepted by the City until <br />it meets the conditions established by the <br />Director of Community Services. Open space or <br />undeveloped land that remains in private ownership <br />shall require an agreement approved by the <br />Director of Community Services specifying the <br />nature of the landscaping and the legal <br />arrangements for maintenance; 5) No residential <br />area shall be permitted to increase its density as <br />approved in this plan by more than 10$; 6) These <br />conditions to be added to the plat of the Master <br />Plan prior to the City Council meeting. This plat <br />is to be available and seen in the McStain sales <br />offices for potential residents; 7) City to <br />maintain the parking area at Harper Lake; 8) The <br />Design Guidelines be an amendment to the Master <br />Plan agreement. <br />Condition #3 was questioned by Council, <br />specifically the wording permits for this develop- <br />ment not being issued until fifty percent of the <br />dwelling units in the Master Plan area are com- <br />pleted." <br />Council contended that in past experience <br />commercial development has come well after <br />residential development and in general, this <br />stipulation is inappropriate. <br />Mayor Meier moved that Condition #3 approved by <br />the Planning Commission be removed from the <br />McStain Master Plan. Morris seconded. Unanimous. <br />Mayor Meier moved that the McStain Master Plan be <br />approved with the remaining Conditions approved by <br />Planning Commission. Cussen seconded. <br />Leary moved that Condition #3 be reworded and <br />placed back into the McStain Master Plan on the <br />basis that McStain should be allowed the same <br />permit allocation incentives as Homart has. <br />Secondly, the wording should indicate that the <br />3 <br />
