Section 16.04.040 of the Louisville Municipal Code and declaring an <br />emergency." <br /> <br />Paul Wood, Planning Director, stated that the purpose of this <br />amendment is to add a fifth exemption to the Subdivision Code, <br />which would exempt a parcel ground from the formal subdivision <br />review process, if the division was for the purpose of purchase, <br />sale, or dedication of additional right-of-way from that parcel to <br />another parcel. <br /> <br />Susan Griffiths, City Attorney, explained that there was one <br />correction to make on Section 1 that the words in parenthesis be <br />deleted, as they are unnecessary. <br /> <br />Sisk: <br /> <br />If we're going to exempt this <br />process under the Subdivision Code, <br />does that mean that it would have to <br />be land immediately adjacent to an <br />existing City right-of-way? Or, <br />could we do a right-of-way that <br />would not necessarily be immediately <br />adjacent, but cut through a person's <br />property leaving a triangle? <br /> <br />Griffiths: <br /> <br />There are already four other <br />exemptions from the subdivision <br />regulations. The wording does not <br />necessarily require that it be <br />immediately adjacent. This doesn't <br />tell the City how it's getting the <br />property. It's saying you do not <br />have to go through the subdivision <br />platting process in order to <br />accomplish what you're trying to <br />accomplish. <br /> <br />Davidson called for further Council questions. <br /> <br />NONE <br /> <br />Howard moved that Council approve Ordinance No. 1148, Series 1994, <br />on first reading and set a public hearing for May 3, 1994. <br />Seconded by Sisk. All in favor. <br /> <br />DISCUSSION/MOTION, ADOPTION OF THE REVISED STANDARD SUBDIVISION <br />AGREEMENT TO INCORPORATE HOURS OF OPERATION OF CONSTRUCTION <br />EQUIPMENT <br /> <br />Paul Wood, Planning Director, stated that staff is requesting the <br />standard Subdivision Agreement to be amended to incorporate the <br />following (SEE ATTACHED). <br /> <br /> <br />
