Davidson suggested changing paragraph 3, page 4, to read "except as provided in paragraph 1 and <br />2, the use of this sub-section C, all revenue from the Use Tax shall be deposited in the city's <br />Conservation Trust Fund and used for open space and parks purposes." <br /> <br />Keany hesitated to donate all of that money to open space and parks funds. He felt other uses would <br />also be appropriate such as the Library or other such services in the city. <br /> <br />Levihn wanted the money used at that particular time for whatever the need of the city is. <br /> <br />Mayer felt the money should be deposited in the CIP Fund or proportionally between the <br />Conservation Trust and the CIP Fund, so it would be going toward growth related activities. <br /> <br />Howard moved that Council approve Ordinance No. 1157, Series 1994, for the period of nine years <br />and to strike the words "January 1, 1995," from the Ordinance and from the header to the Ordinance, <br />as amended by the City Attorney, and as amended by the Mayor. Howard wanted it changed to <br />something like the proportional CIP Fund and the Conservation Trust Fund. <br /> <br />Davidson: <br /> <br />So to clarify, you would be basically changing the last <br />line that says "for Capital Improvement Projects and <br />Conservation Trust Fund." <br /> <br />Howard: Yes. <br /> <br />Mayer seconded. <br /> <br />Lathrop wanted it to be known that, if for some reason by a Court of Jurisdiction this Ordinance is <br />ruled invalid, he will be the first one to support an ordinance to retract this. <br /> <br />Griffiths: <br /> <br />I have a question on the amendment on 3. Is it <br />intended to read "shall be deposited in the city's <br />General Fund and used for Capital Improvement <br />Projects?" <br /> <br />Sharon Asti-Caranci, acting City Administrator, questioned if Howard wanted it the Capital Projects <br />Fund or the combined Capital Improvement Fund. <br /> <br />Howard: <br /> <br />The combined Capital Improvement Fund. <br /> <br />Griffiths: <br /> <br />So, it would be deposited in the combined Capital <br />Improvement Fund and Conservation Trust Fund? <br /> <br />Howard: <br /> <br />Proportionate - 50%/50%. <br /> <br />4 <br /> <br /> <br />
