DISCUSSION/MOTION - LICENSE AGREEMENT: 641 MAIN STREET <br /> <br />Tom Phare, Public Works Director, stated that the Public Works Department had been approached <br />regarding the possible sale of the property at the southwest corner of Pine and Main Street. There <br />was an improvement survey done and found that there was a possible encroachment into the rights- <br />of-way for the existing structure and some of the proposed additions to that existing structure that <br />the buyer intends to make. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Brian Helwig, Real Estate Broker/Caldwell Banker, Boulder, Colorado, representing the buyer, was <br />available to answer any questions. <br /> <br />Davidson called for Council questions. <br /> <br />Howard asked what the structure would be used for. <br /> <br />Helwig stated that the building would be extensively remodeled and will be an upscale espresso <br />coffee/tea shop with muffins, bagels, and probably lunch sandwiches. Eventually, they would turn <br />this into an expanded restaurant. <br /> <br />Lathrop felt the right-of-way encroachment might be a problem years down the road. <br /> <br />Mayer asked how many square feet was involved. <br /> <br />Helwig stated that the encroachment was 4.5 feet. <br /> <br />Mayer asked Tom Phare, Public Works Director, if the city had an interest in this easement. <br /> <br />Phare was unsure, until it is studied, if the city should give up their interest in that parcel. <br /> <br />Levihn pointed out that Karen's, Blue Parrott, and Bud's service station are all right against the <br />sidewalk. <br /> <br />Levihn wanted the subject of sight for right-hand tums addressed. <br /> <br />Sisk wanted this lease agreement presented at the same time as the PUD. <br /> <br />Nancy Campbell, Fowler Real Estate/Better Homes & Gardens, Boulder, Colorado, stated that the <br />encroachment was discovered after the fact and there were some deadlines that they were trying to <br />meet, which was why this was being presented fight now. <br /> <br />Susan Griffiths stated that the license agreement needed to be done by Ordinance. <br /> <br /> <br />
