Griffiths:

Mandrich:

between Northern, Superior, and the
Denver Water Board. What we're
doing is getting water from the
Western Slope through Gross
Reservoir down through South Boulder
Creek. That agreement was to allow
Superior to go forward with our
project until the pipeline was
brought over. It took two
agreements. One with Northern,
Denver, and Superior. The other
with FICO and our district.

We talked about paragraph 1 of the
agreement on the commercial
development. I had asked a follow
up on what Councilmember Sisk was
asking. It was my understanding
from you that the District currently
has additional treatment facilities
completed since May 1, which would
serve .2 million gallons per day for
commercial use. Is that correct?

That's correct under this agreement.
We started our discussions on this
agreement last year and at that time
we wanted to invest in the pipeline
connection between our lines and
Louisville's lines. It's not like
we're opening a valve and we go from
Louisville's system to our system.
We have a series of components to
put in and monitoring devices that
go back to your new water treatment
plant, plus we have to build a line
back through into Superior (the old
town) to connect to our existing
lines. Up front our District would
have to expend $300,000.00 -
400,000.00. All of these items were
laid out with Tom (Phare). We went
through several alternatives to pay
for this water. That's where Tom
came back with the $75,000.00
reserve capacity fee and then an
incremental charge for the water
that's treated.

Hornbostel:

We just got through settling out of
Court with Superior in terms of our
water commitments. If we go back and

18
