Braun: <br /> <br />We will be installing necessary <br />lighting on the sight for parking <br />lots and pedestrian activity after <br />dark. We feel that the <br />responsibility of the streetlights <br />would fall either on the Improvement <br />District or the City. If they deem <br />necessary to install streetlights <br />which have not yet been installed, <br />we would not like to participate in <br />that particular cost. <br /> <br />Mayer: <br /> <br />For the City Attorney, with <br />sidewalks, would there have to be <br />something in the PUD agreement that <br />said exactly at what point the <br />developer of the property would <br />participate in the improvement? <br />What power would the City have with <br />respect to sidewalks? <br /> <br />Susan Griffiths, City Attorney, stated that is preferable to have <br />something in a recorded document that indicates the agreement to <br />take care of the sidewalk. As property changes hands over time, <br />you don't know when the property would be ready to have a sidewalk <br />installed. Future owners might not be aware of the agreement that <br />was entered into. <br /> <br />Mayer: <br /> <br />I have a concern about streetlights. <br />I know of no other, certainly <br />residential developments, that the <br />City allows a development to come in <br />without the developer providing <br />streetlights at some point. What <br />power would the City have in <br />allocating the costs of the people <br />benefiting from the improvements of <br />the streetlights? <br /> <br />Tom Phare: <br /> <br />I not sure. Susan, can you help? <br /> <br />Griffiths: <br /> <br />The one way that I would be aware of <br />that they could do that is to form a <br />Special Improvement District to <br />install streetlights.
