Braun:

We will be installing necessary
lighting on the sight for parking
lots and pedestrian activity after
dark. We feel that the
responsibility of the streetlights
would fall either on the Improvement
District or the City. If they deem
necessary to install streetlights
which have not yet been installed,
we would not like to participate in
that particular cost.

Mayer:

For the City Attorney, with
sidewalks, would there have to be
something in the PUD agreement that
said exactly at what point the
developer of the property would
participate in the improvement?
What power would the City have with
respect to sidewalks?

Susan Griffiths, City Attorney, stated that is preferable to have
something in a recorded document that indicates the agreement to
take care of the sidewalk. As property changes hands over time,
you don't know when the property would be ready to have a sidewalk
installed. Future owners might not be aware of the agreement that
was entered into.

Mayer:

I have a concern about streetlights.
I know of no other, certainly
residential developments, that the
City allows a development to come in
without the developer providing
streetlights at some point. What
power would the City have in
allocating the costs of the people
benefiting from the improvements of
the streetlights?

Tom Phare:

I not sure. Susan, can you help?

Griffiths:

The one way that I would be aware of
that they could do that is to form a
Special Improvement District to
install streetlights. Then, have
the costs of that shared among the
adjoining property owners.

Mayer:

Would that require a majority vote?

Griffiths:

There are two different procedures.
One way is where the property owners

5
