<br />GENERAL PHASING NOTES:
<br />1. RETAINING WALLS MAY BE REQUIRED FOR THE DEVELOPMENT OF THE PROJECT TO THE STANDARDS AND REQUIREMENTS OF
<br />THE CITY, DEVELOPER AND MARKET NEEDS. WALLS WITHIN PRIVATE TRACTS/LOTS, ETC SHALL BE MINIMIZED TO 3', TO THE
<br />EXTENT PRACTICAL. IF FEASIBLE, PRIVATE WALLS SHALL BE TIERED.
<br />2. THERE ARE NO OFF-SITE REGIONAL IMPROVEMENTS REQUIRED FOR THIS PROJECT. OFF-SITE REGIONAL IMPROVEMENTS
<br />BEYOND THOSE DEPICTED WITHIN THIS DOCUMENT SHALL BE BY OTHERS.
<br />3. CONSTRUCTION OF THE IMPROVEMENTS AND ALL USES MAY OCCUR IN ANY ORDER AND IS NOT LIMITED EXCEPT AS
<br />REQUIRED TO PROVIDE A LOOPED WATER SERVICE, SANITARY SERVICE, TWO POINTS OF EMERGENCY ACCESS AND THAT
<br />NO "DEAD END" LONGER THAN 500' WITHOUT A SECONDARY EMERGENCY ACCESS, SHALL OCCUR.
<br />4. IMPROVEMENTS ALONG AND WITHIN THE BNSF RIGHT-OF-WAY FROM GRIFFITH STREET TO SOUTH STREET SHALL BE
<br />COORDINATED WITH THE CITY FOR INCLUSION WITHIN THE CITY'S AGREEMENT WITH BNSF TO ALLOW FOR CONSTRUCTION.
<br />THOSE ITEMS INCLUDE FENCING, RETAINING WALLS, TRANSITIONAL GRADING AND DRAINAGE CONNECTIONS AND MAY BE
<br />INCLUDED WITHIN THE FIRST PHASES OF THE DELO DEVELOPMENT, DEPENDING ON THE TIMING OF THE AGREEMENT. THE
<br />DEVELOPER WILL REIMBURSE THE CITY FOR ANY DELO SPECIFIC FEES ASSOCIATED WITH THE BNSF PERMITTING.
<br />5. THE EXISTING ACCESS TO THE COMCAST SITE WITHIN E. LAFAYETTE STREET ROW MUST BE MAINTAINED UNTIL
<br />THE NORTH FRONT STREET ACCESS IS CONSTRUCTED AND OPERATIONAL.
<br />6. NORTH FRONT STREET, LEONARD LANE AND THE ASSOCIATED UTILITIES IN THE VICINITY OF THE FUTURE E.
<br />LAFAYETTE RIGHT-OF-WAY VACATION AND THAT CROSS THE COMCAST PARCEL SHALL BE CONSTRUCTED
<br />PENDING AN AGREEMENT WITH COMCAST. INFORMATION DEPICTED HEREIN ASSUMES THE AGREEMENT

<br />AVAILABLE. THE DESIGN AND SPECIFICS SHALL BE PRESENTED WITHIN THE SUBSEQUENT PHASE 1
<br />CONSTRUCTION DOCUMENTS.
<br />2. IN THE EVENT THAT AN OFF-SITE FACILITY TO SERVICE THIS PROJECT IS NOT AVAILABLE AT THE TIME OF THE
<br />DEVELOPMENT OF DELO PHASE 1A A TEMPORARY OR PERMANENT DETENTION AND WATER QUALITY
<br />FACILITY SHALL BE CONSTRUCTED ON-SITE TO SERVICE DELO PHASE 1 AND PHASE 1A. THE POND MAY BE
<br />CONSTRUCTED IN A PERMANENT CONFIGURATION IN THE EVENT THAT THE TIMING OF THE OFF-SITE
<br />FACILITY IS NOT ADVANTAGEOUS TO THE DELO DEVELOPMENT. THE DESIGN AND SPECIFICS SHALL BE
<br />PRESENTED WITHIN THE SUBSEQUENT PHASE 1A CONSTRUCTION DOCUMENTS.
<br />3. FUTURE DELO PHASE 2 FINAL PLANNED UNIT DEVELOPMENT SHALL PLAN FOR AND THE SUBSEQUENT
<br />CONSTRUCTION DOCUMENTS SHALL EVALUATE AND DESIGN THE REQUIRED DETENTION AND WATER
<br />QUALITY VOLUME FOR THAT PHASE. AT THAT TIME, SHOULD THE OFF-SITE REGIONAL DRAINAGE FACILITY
<br />NOT BE COMPLETED, A DETERMINATION TO DESIGN AND CONSTRUCT AN PERMANENT ON-SITE FACILITY
<br />SHALL OCCUR.
<br />4. WITH THE DEVELOPMENT OF THE OFF-SITE DRAINAGE FACILITY TO SERVICE THE REDEVELOPMENT AREA
<br />AND THE DELO PROJECT, THE TEMPORARY DETENTION AND WATER QUALITY FACILITIES SHALL BE
<br />REMOVED AND THE DEVELOPMENT OF A PUBLIC GREENWAY SHALL OCCUR.
