Conservancy District adopted the modified western alternative. I hope to convey to them that we're still interested in pursuing the NCWCD, but we have to get the funding mechanism, all of the municipalities, in line. Rather than spend the $10,000.00 in terms of alignment, because I assume that they are no longer going forward with the Boulder County Planning Commission in terms of their dates. It sounds like they may be putting that off too. Phare: That decision is supposed to be made a week from Friday. Sisk: If Superior has not identified themselves as being a player for the additional 4.8 C.F.S., then there no reason to go through with the western alignment. I want it to be made abundantly clear that we would want Superior's decision to reach them by a week from Friday. Annette Brand, City Administrator, thought maybe the Council needs a motion, because she has heard several different opinions. Ho~,ard moved that Council pass a Resolution that states that Council would not allow the Tabor Amendment, in and of itself, to cause Council to come out of the Northern Colorado Water Conservancy District agreement, but that Council's concerns have to do with the western alignment and because of that, Council would like to have Superior's commitment to the 4.8 C.F.S., if that is the driving course for their alignment decision and that Louisville would go no more than 3.0 C.F.S. under any circumstances. Davidson: Kevin, would you make that as a motion, rather than a Resolution? Howard agreed. Seconded by Mayer. Mayer: I think that if we say that we require the western alignment and that our upper bound is 3.0 we don't have to entertain any language about Superior, because that's really for the Water District to figure out.
