October of 1991. The PUD has been <br />amended once for rod iron fencing <br />adjacent to the model units, rather <br />than the stucco fencing. That was <br />done as an administrative amendment, <br />but the administrative amendment did <br />not address the building materials <br />of the fence. The building permit <br />was issued in October of 1991 per <br />Type A (stucco fence) fence on the <br />PUD. I had signed off on the <br />building permit with that note. <br /> <br />Mayer: <br /> <br />Does that mean that the fence up <br />there is in violation of the .... ? <br /> <br />Wood: <br /> <br />Yes. <br /> <br />Mayer: <br /> <br />It seems the facts are clear here. <br />If the City requires something on <br />the permit, the permit should be <br />followed through on. If there is <br />that notation, then that should be <br />adhered to. <br /> <br />Davidson: <br /> <br />The proper thing to do here is to <br />direct staff to look into it and <br />resolve the issue. <br /> <br />Davidson called for any other comments on the fence. <br /> <br />NONE <br /> <br />Howard: <br /> <br />If the PUD says a certain kind of <br />fencing, I would prefer, before the <br />city write off on it, that we would <br />get what we were promised as a <br />City. I noticed that the streets <br />are still 28 ft. across and I would <br />like a comment on that. Also, what <br />does the applicant plan on doing <br />about the possibility of the City <br />taking over these streets? If <br />they're substandard, they're a <br />problem. <br /> <br />Nuszer stated that these are proposed to be private streets and <br />will not be considered for maintenance and ownership by the City of <br />Louisville, unless they are brought into full conformance with City <br />standards in effect at the time maintenance is requested.
