October of 1991. The PUD has been
amended once for rod iron fencing
adjacent to the model units, rather
than the stucco fencing. That was
done as an administrative amendment,
but the administrative amendment did
not address the building materials
of the fence. The building permit
was issued in October of 1991 per
Type A (stucco fence) fence on the
PUD. I had signed off on the
building permit with that note.

Mayer:

Does that mean that the fence up
there is in violation of the .... ?

Wood:

Yes.

Mayer:

It seems the facts are clear here.
If the City requires something on
the permit, the permit should be
followed through on. If there is
that notation, then that should be
adhered to.

Davidson:

The proper thing to do here is to
direct staff to look into it and
resolve the issue.

Davidson called for any other comments on the fence.

NONE

Howard:

If the PUD says a certain kind of
fencing, I would prefer, before the
city write off on it, that we would
get what we were promised as a
City. I noticed that the streets
are still 28 ft. across and I would
like a comment on that. Also, what
does the applicant plan on doing
about the possibility of the City
taking over these streets? If
they're substandard, they're a
problem.

Nuszer stated that these are proposed to be private streets and
will not be considered for maintenance and ownership by the City of
Louisville, unless they are brought into full conformance with City
standards in effect at the time maintenance is requested. He
stated that that note will appear on the PUD on the plat. That
includes snow maintenance.

19
