Grantee shall seed all disturbed areas in the following manner, except on cropland, where <br />instead, the agricultural tenant shall perform reseeding and Grantee shall pay the agricultural <br />tenant for said work at the same hourly rate and in the same manner as listed above. <br />1. The Grantee shall not seed in extremely windy conditions or when the soil is frozen or <br />too wet, as determined by the Primary Contact. <br />2. The Grantee shall complete seeding between October 15th in the same year of Grantee's <br />work in the Easement Area and the following March 1st, or as otherwise directed by the <br />Primary Contact. <br />3. The Grantee shall order, pay for and obtain all seed required for reseeding. Each bag or <br />container of seed must have its original seed tag attached at time of delivery, and the tag <br />must remain attached until the seed is used. The test date shown on seed tags must be <br />current. The Grantee must save and provide all seed tags to the Primary Contact along <br />with seed certification papers with warranty analysis from the seed dealer. <br />4. To drill seed, the Grantee shall use a drill capable of placing the specified seed at the <br />specified rate at a 3/4" depth. The drill should have an 8" or less drill row spacing and be <br />equipped with packer wheels to firm the soil over the drill row. Dragging chains behind <br />the drill to cover seed is not an acceptable substitute. <br />5. Areas that cannot be drilled may be broadcast seeded. The specified seeding rate in these <br />areas shall be doubled. Hydroseeding is not acceptable. Broadcast seed shall be raked, <br />harrowed or otherwise covered by soil to a depth of 1/2" to 3/4". <br />6. Areas that cannot be drilled may be broadcast seeded; however, hydroseeding is not <br />acceptable. The specified seeding rate in these areas shall be doubled. Broadcast seed <br />shall be raked, harrowed or otherwise covered by soil to a depth of 1/2" to 3/4". <br />Mulching (Non -Crop Land Onlv) <br />Seed shall be applied separately and prior to mulching. Within 24 hours of seeding, the Grantee <br />shall apply mulch to all seeded areas, and Grantee shall re -seed and re -mulch at Grantee's sole <br />expense any and all areas not properly mulched within 24 hours after seeding and any areas <br />where seeding or mulching fails due to improper application. Grantee shall avoid walking or <br />driving on the seedbed and mulched areas. <br />For slopes that are less than 3:1 or flatter, Grantee shall use mulching method A or B: <br />A. Colorado Certified Weed -Free Hay or Straw Mulch: Only native hay or straw mulch that <br />has been certified by the Colorado State Department of Agriculture as weed -free may be <br />used, and additionally, the mulch may not contain cheatgrass (Bromus tectorum and Bromus <br />japonicas). Straw must be from the State of Colorado and comply with the Colorado <br />Department of Agriculture Weed Free Forage regulations.
