Local Licensing Authority <br />Minutes <br />May 22, 2017 <br />Page 4 of 7 <br />Chairperson Lipton opened the show cause hearing on the 3/29/17 incident and <br />outlined the hearing procedure. <br />Lipton asked for attorneys for the prosecution and the licensee introduce <br />themselves. Adam GoIlin, Special Prosecutor, introduced himself and stated he <br />was ready to proceed. <br />Authority Attorney Culley noted for the record the licensee was notified of the <br />hearing, a phone call was made and the licensee reported he would not be <br />attending. Licensee not present or represented. <br />Prosecutor GoIlin noted the bartender mentioned in the report was issued a <br />municipal court summons for a violation of the Louisville Municipal Code of <br />serving to a visibly intoxicated person. He entered into the record as Exhibit 1 <br />the court disposition showing the defendant had entered into a deferred <br />judgement after a guilty plea. He asked the Authority to take judicial notice of the <br />guilty plea and find that the license be suspended. He noted the burden of proof <br />is higher in municipal court than in Authority proceedings. <br />Carlson moved the violation of serving to a visibly intoxicated person has been <br />proven. Hervey seconded. Roll Call Vote: Hervey — yes, Lipton — yes, <br />Tennessen — yes, Carlson — yes and Machado- yes. <br />Lipton moved the order to show cause be entered into the record. Machado <br />seconded. All in favor. <br />D. Show Cause Hearing — Hei Han Enterprises, Inc. d/b/a Henry's Bar & <br />Grill — Tavern Liquor License — 935 Pine St. — 2/19/17 Incident <br />Lipton opened the show cause hearing. She outlined the hearing procedure. <br />Adam GoIlin, Special Prosecutor stated he was ready to proceed. He noted the <br />licensee was not represented and not present for the hearing. <br />Mr. GoIlin called Joshua Thies to the witness stand. Mr. Thies, took the oath. <br />Mr. GoIlin asked Mr. Thies if he worked as a bartender at Henry's Bar & Grill, 935 <br />Pine Street, Louisville, CO in Boulder County. Mr. Thies responded yes and <br />noted he was working the night of February 19, 2017. A group of gentlemen <br />came into the bar that night, were served no more than 2 or 3 drinks apiece. He <br />cut one gentlemen off after just one drink as the group was beginning to get <br />rowdy. Mr. Thies said they were in the bar somewhere around 9-11 pm and <br />then left. One patron came back and threatened Mr. Thies. <br />Mr. Thies reported he has been a bartender for over a decade. This threat <br />seemed different and he took it seriously.
