Local Licensing Authority <br />Minutes <br />June 26, 2017 <br />Page 4 of 7 <br />Machado thanked the applicant, closed the public hearing and asked for <br />Authority comment. <br />Tennessen moved the Local Licensing Authority of the City of Louisville find <br />the applicant is of good moral character, the inhabitants of the neighborhood <br />desire the license be granted, the license will meet the reasonable <br />requirements of the neighborhood, all City and State law requirements have <br />been met and, based on these findings, the Local Licensing Authority <br />approve issuance of a hotel and restaurant liquor license for Main Street <br />Tacos LLC doing business as Main Street Tacos. Hervey seconded. Roll <br />Call Vote: Machado — yes, Tennessen — yes, Hervey — yes. License <br />approved. <br />B. Show Cause Hearing — Cinebarre LLC d/b/a Cinebarre — Hotel and <br />Restaurant Liquor License — 1164 W. Dillon Rd. - 3/10/17 Incident <br />Machado introduced the agenda item. Adam GoIlin, Special Prosecutor for the <br />Authority introduced himself. Brian Proffitt, Attorney for Cinebarre introduced <br />himself and noted Sarah Schulhauser, manager of Cinebarre was also present <br />should the Authority have any questions for her. <br />Acting Chairperson Machado opened the public hearing and noted the attorneys <br />had introduced themselves and reported there was a stipulation for the Authority <br />to consider. <br />Mr. GoIlin described the incident. An employee was off duty and sitting at the bar <br />and the bartender served him even though he was underage. Both employees <br />were fired; the bartender was cited into municipal court and pled guilty to serving <br />to an underage person. <br />Cinebarre was very cooperative with the investigation. Ms. Schulhauser, the <br />manager, provided the police with everything they requested. <br />Mr. GoIlin noted the stipulation called for a 3 day suspension with 2 days held in <br />abeyance, training for employees and no violations in the next year. He noted <br />the licensee had also included a request to pay a fine in lieu. <br />Mr. Proffitt noted both employees involved were no longer with the company. <br />The manager on duty also received a suspension. He asked the Authority <br />accept the fine in lieu and allow a couple of weeks to get the check cut. He <br />noted Ms. Schulhauser was not there the night of the incident but readily <br />supplied all information to the police department the next day. <br />Tennessen felt the stipulation was fair considering how cooperative the licensee <br />had been following the incident. <br />
