Louisville City Council Meeting <br />March 2, 2004 <br />Page 4 of 10 <br /> <br />Mayor Sisk opened the public hearing and asked if anyone in the audience wished to <br />speak for or against Ordinance No. 1441, or Ordinance No. 1442, Series 2004. Hearing <br />none, Mayor Sisk closed the public hearing. <br /> <br />MOTION: Council member Brown moved to approve Ordinance No 1441, Series 2004, <br />seconded by Council member Levihn. Roll call vote was taken. The motion passed by a <br />vote of 7-0. <br /> <br />COUNCIL COMMENT <br /> <br />Mayer Sisk stressed the importance of the annexation and zoning of the two properties to <br />complete the Highway 42/96th Street Connection project. <br /> <br />Brown inquired if the right-of-way was anticipated when the jointly owned open space <br />property was purchased. City Manager Simmons confirmed it was anticipated. <br /> <br />MOTION: Council member Brown moved to approve Ordinance No. 1442, Series 2004, <br />seconded by Council member Van Pelt. Roll call vote was taken. The motion passed by a <br />vote of 7-0. <br /> <br />RESOLUTION NO. 13, SERIES 2004 - A RESOLUTION APPROVING A MINOR <br />SUBDIVISION PLAT FOR ACME PLACE, REPLAT "A", A REPLAT OF LOTS <br />8, 9 AND 10, BLOCK 5, ACME PLACE SUBDIVISION (533 & 537 LINCOLN <br />AVENUE) <br /> <br />Mayor Sisk called for Staff presentation. <br /> <br />Principal Planner Ken Johnstone reviewed the background of the subject property. It is <br />under single ownership and includes two residential structures with addresses of 533 and <br />537 Lincoln Avenue, Lots 8, 9 and 10, Block 5, Acme Place Subdivision, and was platted <br />in 1893. The parcel is 75 feet wide and 114.5 feet deep and is 8,586 SF in area. Pursuant <br />to the Louisville Municipal Code, Section 16.12.120, the property owners, Jim and <br />Laurie Boyer, have requested the property be split into two parcels, one for each existing <br />home. The Planning Commission reviewed the application and recommends approval <br />with two conditions. 1) The property owner shall install separate, private sanitary sewer <br />connections from the public sanitary main to each house, subject to Public Works <br />Department plan review, inspections and final approval. 2) A shared access easement <br />shall either be added to the plat or be recorded by separated instrument. <br /> <br />Mayor Sisk called for Applicant presentation. <br /> <br />Jim Boyer, 537 Lincoln Avenue, Louisville, CO, stated he and his wife own the <br />properties located at 533 and 537 Lincoln Avenue. He explained from 1900 through <br />1945, County records reflect the property contained two individual lots. He requested <br />Council consideration on the subdivision replat to return the property to two separate lots. <br /> <br /> <br />
