City Council <br />Meeting Minutes <br />March 18, 2008 <br />Page 5 of 10 <br />Manager Fleming confirmed it was Council's decision not to exceed $35,000 for <br />the market analysis however some of the responses to the RFP are more than <br />$35,000 and the reported $5,000 increase would facilitate negotiations. <br />Mayor Sisk commented the City could consider GIS for water metering. <br />There was no other Council or public comments. The public hearing was closed. <br />MOTION: Mayor Pro Tem M~arsella moved to approve Resolution No. 11, Series <br />2008, with the addition of $5,000 to the General Fund, seconded by Councilor <br />Sackett. Roll call vote was taken. The motion carried by a vote of 7-0. <br />NOTICE OF INTENT TO I~CQUIRE RIGHT-OF-WAY FOR DILLON ROAD <br />PROJECT <br />Mayor Sisk requested a City ~4ttorney presentation. <br />City Attorney Light read Ordinance No. 1531, Series 2008 and explained there <br />are two parts to this agenda item; 1) Ordinance No. 1531, Series 2008 and 2) <br />Notice of Intent to Acquire Right-of-Way for the Dillon Road Project. Staff <br />requests Council approval of the notice and ordinance on first reading. Staff will <br />publish the notice along with 1the ordinance as required by the Municipal Code. <br />Mayor Sisk requested a Staff presentation. <br />Public Works Director Phare explained there are six property owners along Dillon <br />Road the City will be asking fier easements in conjunction with the Dillon Road <br />Project. <br />Mayor Sisk voiced his concern over the insertion of condemnation in the <br />ordinance. City Attorney Lighit explained if condemnation is removed from the <br />ordinance, a second ordinance may be required in order to preserve the option to <br />condemn. The ordinance identifies and designates the specific parcels required <br />for public use in the connection with the project and authorizes acquisition by <br />negotiations, which are ongoing, and by condemnation if necessary. <br />ORDINANCE No. 1531, SERIES 2008 - AN ORDINANCE DESIGNATING <br />CERTAIN PROPERTY AS BEING REQUIRED FOR THE PUBLIC USE FOR <br />THE DILLON ROAD PROJECT AND AUTHORIZING THE ACQUISTION <br />THEREOF THROUGH NEGOTIATION AND/OR CONDEMNATION - 1sc <br />Readirng -Set Public Hearing 4/1/08 <br />MOTION: Mayor Sisk moved Council approve Ordinance No. 1531, Series 2008 <br />on first reading have it sent out for publication and set a public hearing for April 1, <br />2008, seconded by Councilor Dalton. <br />
