The subject, parcel is zoned Commercial Neighborhood <br />(CN) and is approximately 6,500 square feet in area. The property is bound to <br />the north and south by CN zoned properties; an engineering firm on the north <br />and an office building on the south. The Louisville Middle School is to the west <br />and the Burlington Northern Sante F~e (BNSF) rail line is to the east. <br />The Patchwork School provides child care and pre-school education for children <br />ranging in ages from 2.5 to 8 years old (pre-school through third grade). The <br />maximum number of students for this request is 28 students and 4 staff <br />members. The hours of operation will be from 8:00 a.m. to 4:00 p.m., Monday <br />through Friday. The times were chosen so as not to interfere with the hours of <br />the Louisville Middle School. Pick-up and drop-off will be located on Main Street. <br />Staff recommends the area be signed for "pick up and drop off only". <br />The front and rear yards will be fenced and there will be an adult outdoor monitor <br />present when children are outside. 'The Louisville Municipal Code states outdoor <br />play areas for children shall be enclosed by a solid fence six feet in height. The <br />applicant has requested a waiver to permit a 4' fence returns, which attaches to <br />the house. Staff supports the 4' return because the balance of the property has a <br />6' fence. Additionally there is a 4' chain link fence on the front property line. <br />Originally, the applicant planned for employee parking in the rear, but with the <br />future development of FasTracks this area will require fencing and be closed to <br />any public access. Staff requires the applicant to plan an alternative parking <br />provision for employees. <br />The Fire Marshall and the Chief Building Official reviewed the occupancy <br />regulations of the request and approved the number of students being requested. <br />The applicant met with the Chief Building Official relative to a punch list of fire <br />safety items that need to be completed prior to occupancy. <br />The Planning Commission held a public hearing on July 10, 2008 and forwarded <br />a recommendation of approval with the following conditions: <br />1. The applicant shall provide an all weather on-site parking area or a third <br />party parking agreement with the property to the south for staff parking. <br />2. A trash/recycling area shall be constructed on the site that will adequately <br />serve this use. <br />3. The Special Review Use is granted to the applicant only and is for a <br />maximum of 28 students. <br />The applicant has agreed to all of the conditions and provided a Third Party <br />Parking Agreement and a new site plan showing trash/recycle enclosures. <br />
